AN ORDINANCE VACATING THE EAST-WEST ALLEY
LOCATED WITHIN BLOCK 121, FLETCHER HILL ADDITION
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The following described alley:
A PORTION OF THE SOUTHWEST QUARTER OF SECTION 29, TOWNSHIP
20 SOUTH, RANGE 64 WEST,OF THE 6TH PRINCIPAL MERIDIAN, AND
BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
AN EAST-WEST 16 FOOT WIDE ALLEY BOUND ON THE NORTH SIDE BY
LOTS 19 THROUGH 26, BLOCK 121 OF FLETCHER HILL ADDITION TO THE
CITY OF PUEBLO, COUNTY OF PUEBLO, STATE OF COLORADO AS
RECORDED IN THE PUEBLO COUNTY RECORDS IN BOOK 3, PAGE 26 AND
BOUND ON THE SOUTH SIDE BY LOT 1, EAST SIDE LIBRARY.
CONTAINING A CALCULATED AREA OF 3,199.52 SQ. FEET, OR 0.073
ACRES.
AND
A PORTION OF THE SOUTHWEST QUARTER OF SECTION 29, TOWNSHIP
20 SOUTH, RANGE 64 WEST,OF THE 6TH PRINCIPAL MERIDIAN, AND
BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
THE WEST 20 FEET OF LOT 19, BLOCK 121, FLETCHER HILL ADDITION TO
THE CITY OF PUEBLO, COUNTY OF PUEBLO, STATE OF COLORADO AS
RECORDED IN THE PUEBLO COUNTY RECORDS IN BOOK 3, PAGE 26.
CONTAINING A CALCULATED AREA OF 2,397.54 SQ. FEET, OR 0.055
ACRES.
is hereby vacated.
SECTION 2.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of this Ordinance to effectuate the policies and
procedures described herein.

SECTION 3.
This Ordinance shall become effective immediately upon final passage and
approval.

SUBJECT:AN ORDINANCE VACATING THE EAST-WEST ALLEY LOCATED
WITHIN BLOCK 121, FLETCHER HILL ADDITION
SUMMARY:
The applicant is requesting to vacate the east-west alley located within Block 121,
Fletcher Hill Addition.
PREVIOUS COUNCIL ACTION:
There is a concurrent request to rezone the north half of the alley from B-2, Subregional
Business District to S-1, Governmental Use District.
BACKGROUND:
The subject property is located north of the East Side Library, currently under
construction. The applicant is proposing to vacate the alley and rezone the north half of
the alley to S-1 so that the zoning in consistent with the entire property. The entire alley
will be combined with the East Side Library property once the vacation is complete, per
a contract with Safeway. A sanitary sewer line is existing in the alley; therefore, a utility
easement is being reserved in the vacated alley to allow it to remain.
FINANCIAL IMPLICATIONS:
None.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their August 13, 2014 Regular Meeting, voted
5-0 to recommend approval.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission
Public Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
Deny the Ordinance.
Upon request of City Council, the Ordinance could be returned to the Planning and
Zoning Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.
