HomeMy WebLinkAbout08807ORDINANCE NO. 8807 AN ORDINANCE CHANGING ZONING RESTRICTIONS FOR THE NORTH HALF OF THE ALLEY LOCATED WITHIN BLOCK 121, FLETCHER HILL ADDITION FROM B-2, SUBREGIONAL BUSINESS DISTRICT TO S-1, GOVERNMENTAL USE DISTRICT BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering a parcel of land located within the North half of the alley within Block 121, Fletcher Hill Addition are hereby changed from B-2, Subregional Business District to S-1, Governmental Use District and upon passage of this Ordinance, zoning restrictions affecting S-1, Governmental Use District, shall apply to said property as follows: A PORTION OF THE SOUTHWEST QUARTER OF SECTION 29, TOWNSHIP 20 SOUTH, RANGE 64 WEST,OF THE 6TH PRINCIPAL MERIDIAN, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: THE NORTHERN HALF OF THE ALLEY ADJACENT TO LOT 1, EAST SIDE LIBRARY, AND EXTENDING INTO THE ADJACENT RIGHT-OF-WAY OF N. MONUMENT AVENUE TO THE CENTERLINE OF SAID RIGHT-OF-WAY; IN FLETCHER HILL ADDITION, CITY OF PUEBLO, COUNTY OF PUEBLO, STATE OF COLORADO, AS RECORDED UNDER BOOK 3, PAGE 26 OF THE RECORDS OF PUEBLO COUNTY. CONTAINING A CALCULATED AREA OF 1,840.88 SQ. FEET, OR 0.043 ACRES. SECTION 2. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of the Ordinance to effectuate the policies and procedures described herein. SECTION 3. This Ordinance shall become effective immediately upon final passage and approval. Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Steven Meier, Planning and Community Development SUBJECT: AN ORDINANCE CHANGING ZONING RESTRICTIONS FOR THE NORTH HALF OF THE ALLEY LOCATED WITHIN BLOCK 121, FLETCHER HILL ADDITION FROM B-2, SUBREGIONAL BUSINESS DISTRICT TO S-1, GOVERNMENTAL USE DISTRICT SUMMARY: The applicant is requesting to rezone the north half of the east-west alley located within Block 121, Fletcher Hill Addition. PREVIOUS COUNCIL ACTION: None. BACKGROUND: The subject property is located north of the East Side Library, currently under construction. The applicant is proposing to vacate the alley and rezone the north half of the alley to S-1 so that the zoning is consistent with the entire property. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their August 13, 2014 Regular Meeting, voted 5-0 to recommend approval with conditions. Subsequently, the applicant has complied with all conditions of approval. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance, the current zoning would remain. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance.
