GRAND AVENUE FROM O-1, NEIGHBORHOOD OFFICE DISTRICT TO R-3, ONE AND TWO-FAMILY RESIDENTIAL DISTRICT BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering a parcel of land located at 2414 N. Grand Avenue are hereby changed from O-1, Neighborhood Office District to R-3, One and Two-Family Residential District and upon passage of this Ordinance, zoning restrictions affecting R-3, One and Two-Family Residential District, shall apply to said property as follows: Lots 8 and 9, Block 8, Garfield Place, and the East 8 ft. of the existing alley lying East of Lots 8 and 9, and the West 40 ft. of Grand Avenue adjacent to Lots 8 and 9, Block 8, Garfield Place. County of Pueblo, State of Colorado SECTION 2. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of the Ordinance to effectuate the policies and procedures described herein. SECTION 3. This Ordinance shall become effective immediately upon final passage and approval. Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Steven Meier, Planning and Community Development SUBJECT: AN ORDINANCE CHANGING ZONING RESTRICTIONS FOR A PARCEL OF LAND LOCATED AT 2414 N. GRAND AVENUE FROM O-1, NEIGHBORHOOD OFFICE DISTRICT TO R-3, ONE AND TWO-FAMILY RESIDENTIAL DISTRICT SUMMARY: The applicant is requesting to rezone 0.19 acres from O-1 (Neighborhood Office District) to R-3 (One and Two-Family Residential District). PREVIOUS COUNCIL ACTION: None. BACKGROUND: The applicant’s request will effectively down-zone the property located at 2414 N. Grand Avenue to its pre-1999 R-3 zoning classification. Reestablishing a residential use of the property is compatible within the context of the neighborhood. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their May 14, 2014 Regular Meeting, voted 5- 0 to recommend approval with Commissioners Burrer and Lucas absent. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance, the current zoning would remain. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance.
