AN ORDINANCE APPROVING A MUTUAL AID
MEMORANDUM OF UNDERSTANDING (MOU) BETWEEN
THE TENTH JUDICIAL DISTRICT COMBINED COURTS;
THE PUEBLO COUNTY SHERIFF’S OFFICE; THE OFFICE
OF THE DISTRICT ATTORNEY, TENTH JUDICIAL
DISTRICT; THE PUEBLO POLICE DEPARTMENT; THE
TENTH JUDICIAL DISTRICT PROBATION OFFICE; THE
OFFICE OF THE COLORADO STATE PUBLIC DEFENDER
& DIVISION OF ADULT PAROLE; AND SPANISH PEAKS
BEHAVIORAL HEALTH CENTERS, AND AUTHORIZING
THE PRESIDENT OF CITY COUNCIL TO EXECUTE SAME
WHEREAS, the City Council of Pueblo has the authority on behalf of the City of
Pueblo, including its Police Department, to accept the MOU between all aforementioned
agencies; and
WHEREAS, acceptance of the MOU for the purposes for which it has been made
is in the best interest of the City and will benefit the health, welfare, and safety of the
citizens of the City; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Memorandum of Understanding, dated November 24, 2014, between all
aforementioned agencies, relating to the operation of a joint Treatment Alternatives
Collaboration, a true copy of which is attached hereto, having been approved as to form
by the City Attorney, is hereby approved.
SECTION 2.
The President of the City Council is hereby authorized to execute the
Memorandum of Understanding on behalf of Pueblo, a Municipal Corporation, and the
City Clerk is directed to affix the seal of the City thereto and attest same.
SECTION 3.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of this Ordinance to effectuate the policies and
procedures described herein.
SECTION 4.
This Ordinance shall become effective immediately upon final passage.

PAROLE; AND SPANISH PEAKS BEHAVIORAL HEALTH CENTERS,
AND AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO
EXECUTE SAME
SUMMARY:
Memorandum of Understanding relating to the
Attached is an Ordinance that approves a
continuation of a joint Treatment Alternatives Collaboration between the aforementioned
agencies.
PREVIOUS COUNCIL ACTION:
Previous MOUs of this nature have routinely been approved each time.
BACKGROUND:
The mutual agreement concept, which utilizes an interagency approach involving the
aforementioned agencies, is necessary to identify and offer treatment options to
offenders who have a mental illness or co-occurring substance abuse disorder which
may be contributing to their involvement in the criminal justice system.
FINANCIAL IMPLICATIONS:
Administration of this MOU will require staff time within the Police Department to work
cooperatively with all aforementioned agencies.
BOARD/COMMISSION RECOMMENDATION:
None.
STAKEHOLDER PROCESS:
There is no stakeholder process required for this MOU.
ALTERNATIVES:
Decline the opportunity to work together, hindering service to our citizens.
RECOMMENDATION:
Approval of the Ordinance.
Attachments:
o Drug and alcohol testing
o Case Management Services
o Medication Evaluation by SPBHC psychiatric staff
o Ongoing medication management by the SPBHC psychiatric staff
o Assertive Community Treatment(ACT)Services
o Transitional Employment(TE)and Supported Employment(SE)opportunities
o Vocational Rehabilitation services and educational services, in coordination with
Colorado Division of Vocational Rehabilitation
o Residential treatment for individuals who would benefit from professional oversight and
assistance with Activities of Daily Living
o Intensive residential mental health treatment at our Acute Treatment Unit (ATU)for
individuals whose illness are more acute and require medication management and
intensive treatment and supervision on a 24-hour basis
o Emergency services with 24/7 availability
o Assistance with locating safe and stable housing and assistance with application for
financial assistance (assistance with application for benefit acquisition, payeeship
services, HUD vouchers and other supported living options).
o Consumer-facilitated support groups and Clubhouse activities.This includes social and
recreational supports, as well.
• SPBHC will track, compile and report program statistics to the State and to partner agencies
o SPBHC will provide IT support and assistance, as necessary,to facilitate information sharing,
communication and other technical support, in coordination with other agencies' IT personnel.
• In collaboration with law enforcement agencies,SPBHC will support and assist with the
provision of Crisis Intervention Training (CIT)for at least 25 officers/deputies during FY 2014-15
• SPBHC will provide and participate in inter-agency cross-training, as needed, to facilitate
education,communication and collaboration. This cross-training will be at no cost to the agency
receiving the training.
COMMUNITY PARTNERS:
o Each agency will assign at least one dedicated staff liaison to participate in a meeting/case
staffing, as needed.
o Each agency representative will be responsible for maintaining communication with all parties
regarding specific cases and procedural issues.
• Each partner agency will provide information, including statistics and client progress
information,to SPBHC,as necessary, to document progress and outcomes of the TAC Program.
• Confidential information will be shared between agencies, as allowed by law, regarding mutually
served individuals.Such confidential information shall be treated in the legally prescribed
manner dictated by law.
• The Pueblo County Sheriffs' Office,the Pueblo Police Department and the Division of Adult
Parole will identify officers/deputies to receive CIT Training during the 2014-2015 Fiscal Year.

• The Sheriffs'Office and Detention Center and the Police Department will make available space
for the TAC Treatment Team to meet with prospective clients,as needed.The space will be
conducive to confidentiality.
• All partners in this collaboration agree to pursue opportunities to guarantee sustainability of the
program.
• The Community Partners will continue to participate in the TAC Program collaboration to the
extent that funding is appropriated and available.
TIME,RENEWAL AND TERMINATION
This Memorandum of Understanding shall be effective for one (1)year from the latest date of the
signatory below and may be extended upon written mutual agreement. Any party may terminate their
agreement to this Memorandum of Understanding without cause upon thirty(30)days written notice to
the other parties.
AUTHORIZATION
The signatories will strive to reach,to the best of their ability,the objectives stated in the MOU.
