Attached is a resolution awarding a construction contract to Cortez Construction Co.,

Inc. for emergency sanitary sewer point repair in the alley behind 119 West 6 Street.

BACKGROUND
:
On September 3, 2014, a cleaning head and hose became stuck in a hole in a broken
8-inch sanitary sewer main. If left, the cleaning head and hose could cause wastewater
to back up in businesses which tie into this main. Due to the high risk of backups into
these businesses, causing public health and safety problems, it was determined that the
main needed to be repaired and the cleaning head and hose removed. Cortez
Construction Co., Inc. was asked to install a new section of 8-inch pipe to ensure raw
wastewater did not backup into the adjacent properties to the main and to ensure public
health and safety.
The quote for the unit prices for the work by Cortez Construction Co., Inc. and the
change order for the project are attached. This work was performed under the Sanitary
Sewer Point Repair multi-year contract under which nine (9) contractors were qualified
via competitive bid. During the project the costs were modified by actual field quantities
as noted on the attached change order.
The cost breakdown for the project is as follows:

FINANCIAL IMPLICATIONS
:
Funding for this project will come from the sanitary sewer rehabilitation budget funded
by the Sewer User Fund. Funding was available and had been budgeted, appropriated
and allocated to Project No. 13-012 (WWAN03).

ALTERNATIVES
:
Alternative No. 1 – No Action
Under this alternative, the City would make no improvements to the existing sanitary
system and the cleaning head and hose would remain in the sewer main. This could lead
to backups into the properties tying into the main. Backups cause a serious health and
safety concern to the public.
Alternative No. 2 – Place the Main on the Rehabilitation List
Under this alternative, the City would make no immediate repairs to the sanitary sewer.
The main would be put on a rehabilitation list and prioritized by the level of importance for
future rehabilitation projects. In addition, the cleaning head and hose would remain in the
main and could eventually lead to backup of raw sewage into the adjacent properties.
Due to this risk of backup, a serious health and safety issue would still be present to the
public.
RECOMMENDATION

WHEREAS, an emergency sanitary sewer repair was authorized by the Pueblo City
Manager in accordance with Section 1-10-5 of the Pueblo Municipal Code ; and
WHEREAS, the point repair work was awarded to Cortez Construction Co., Inc., under
the 2013-2014 multi-year point repair contract ; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:

This contract is for repair of the sanitary sewer main in the alley behind 116 West 6
Street. Contract Agreement for Sanitary Sewer Repair with Cortez Construction Co., Inc.,
Project No. 13-012 (WWAN03) is hereby awarded to said bidder in the amount of $5,134.75.
SECTION 2.
Funds for Project 13-021 (WWAN03) shall be from the Sewer User Fund.
SECTION 3.
The Purchasing Agent is hereby authorized to execute said contract on behalf of Pueblo,
a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the
same.
SECTION 4.
The officers and staff of the City are directed and authorized to perform any and all acts
consistent with the intent of this Resolution and the contract to effectuate the transactions
described therein. Furthermore, all actions previously taken by officers and staff of the City
consistent with the contract including any payments authorized under the contract are hereby
ratified.
SECTION 5.
This Resolution shall become effective immediately upon passage and approval.
