HomeMy WebLinkAbout13095RESOLUTION NO. 13095 A RESOLUTION APPROVING THE TRANSFER OF BUDGETED AND APPROPRIATED WASTEWATER FUNDS IN THE AMOUNT OF $79,953 FROM PROJECTS TO BE DETERMINED (WW1399) AND $150,000 FROM PROJECTS TO BE DETERMINED (WW1499) TO EMERGENCY/POINT REPAIR (WWAN03) AND $10,000 FROM PROJECTS TO BE DETERMINED (WW1499) TO SMALL MAIN REHABILITATION (WWAN01) WHEREAS, the City of Pueblo owns, operates, and maintains a wastewater collection and treatment system subject to the requirements of the Federal Clean Water Act and the Colorado Water Quality Control Act; and WHEREAS, the City of Pueblo has budgeted and appropriated $1,193,928 to Projects to be Determined of which $229,953 is needed for the Emergency/Point Repair Projects (WWAN03) and $10,000 is needed for the Small Main Rehab (WWAN01); NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Finance Director is hereby authorized to execute the transfer of $79,953 from Projects to be Determined (WW1399) and $150,000 from Projects to be Determined (WW1499) to Emergency/Point Repair (WWAN03) and $10,000 from Projects to be Determined (WW1499) to Small Main Rehab (WWAN01). SECTION 2. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Resolution and to effectuate the transactions described herein. SECTION 3. This Resolution shall become effective immediately upon passage and approval. INTRODUCED: November 10, 2014 BY: Chris Nicoll City Clerk’s Office Item # M-8 Background Paper for Proposed Resolution COUNCIL MEETING DATE: November 10, 2014 TO: Vice President Ami Nawrocki and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk From: Gene Michael, Wastewater Director A RESOLUTION APPROVING THE TRANSFER OF BUDGETED AND SUBJECT: APPROPRIATED WASTEWATER FUNDS IN THE AMOUNT OF $79,953 FROM PROJECTS TO BE DETERMINED (WW1399) AND $150,000 FROM PROJECTS TO BE DETERMINED (WW1499) TO EMERGENCY/POINT REPAIR (WWAN03) AND $10,000 FROM PROJECTS TO BE DETERMINED (WW1499) TO SMALL MAIN REHABILITATION (WWAN01) SUMMARY: Attached is a resolution transferring funds from Projects to Be Determined (WW1399 AND WW1499) to Emergency/Point Repair (WWAN03) and Small Main Rehabilitation (WWAN01). This proposed transfer of funds will cover a recent sanitary sewer main break within the City of Pueblo and provide some additional resources to deal with other emergency conditions that may be discovered during the remainder of 2014. PREVIOUS COUNCIL ACTION : None BACKGROUND : The Water Reclamation Facility operates and maintains approximately 470 miles of sanitary sewer main. Whenever a condition is discovered that poses an imminent threat to public health and the environment or to property, an emergency repair is performed to maintain compliance with environmental laws and to protect citizens. The cost of nd repairing a recent sanitary sewer main break on 2 and Grand Street will exceed the amount currently available in the Emergency/Point Repair (WWAN03) project balance. This proposed transfer of funds will cover the cost of this recent break and provide resources to deal with other emergency conditions that may be discovered during 2014. FINANCIAL IMPLICATIONS : Funding for this project will be taken from Projects to be Determined (WW1399 and WW1499). Funds are available from the Sewer User Fund and were budgeted and appropriated in the 2014 budget. BOARD/COMMISSION RECOMMENDATION : Not Applicable STAKEHOLDER PROCESS : Not Applicable ALTERNATIVES : Alternative No. 1 – No Action Under this alternative, the City would not do repairs to the existing sanitary mains and the system would remain as is. Doing nothing could introduce unsanitary conditions to the public as well as contaminate ground water sources with raw sewage and could subject the City to fines from the Colorado Department of Health and Environment or from the Environmental Protection Agency for failure to comply with environmental laws, and could also subject the City to liability from third party law suits. Alternative No. 2 – Provide Emergency/Point Repairs as Needs Arise Under this alternative, whenever a condition is discovered that poses an imminent threat to public health or property, an emergency repair will be performed to maintain compliance with environmental laws and to protect citizens. For each incident, individual budget transfers will have to be completed, leading to reduced efficiency and duplicated effort on the part of the Wastewater Department, the Law Department, the Finance Department, the City Manager’s Office, and the City Council. RECOMMENDATION : Approval of the Resolution.
