HomeMy WebLinkAbout08788ORDINANCE NO. 8788 AN ORDINANCE CHANGING ZONING RESTRICTIONS FOR A PARCEL OF LAND LOCATED AT 2705-2719 FARABAUGH LANE FROM B-3, HIGHWAY AND ARTERIAL ZONE DISTRICT TO BP, BUSINESS PARK DISTRICT BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering a parcel of land located at 2705-2719 Farabaugh Lane are hereby changed from B-3, Highway and Arterial Zone District to BP, Business Park District and upon passage of this Ordinance, zoning restrictions affecting BP, Business Park District, shall apply to said property as follows: Lot 3, Block 4, South Prairie Subdivision Filing No. 2, together with the North ½ of Farabaugh Lane and West ½ of Broadmoor Road immediately adjacent to said Lot, all in The City of Pueblo, County of Pueblo, State of Colorado. SECTION 2. The Ordinance is approved with the following conditions: 1. Provide a rezoning exhibit and site plan in dwf format. 2. Provide a landscape plan, bringing the landscape setback areas into compliance with Section 17-4-7 of the Pueblo Municipal Code. Landscaping must be installed within one (1) year of the rezoning approval. SECTION 3. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of the Ordinance to effectuate the policies and procedures described herein. SECTION 4. This Ordinance shall become effective immediately upon compliance with the conditions of approval noted above. Daff and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Steven Meier, Planning and Community Development SUBJECT: AN ORDINANCE CHANGING ZONING RESTRICTIONS FOR A PARCEL OF LAND LOCATED AT 2705-2719 FARABAUGH LANE FROM B-3, HIGHWAY AND ARTERIAL ZONE DISTRICTTO BP, BUSINESS PARK DISTRICT SUMMARY: The applicant is requesting to rezone the property at 2705-2719 Farabaugh Lane from B-3, Highway and Arterial Zone District to BP, Business Park Zone District. The applicant would like to lease a portion of the existing building for a marijuana cultivation facility. PREVIOUS COUNCIL ACTION: None. BACKGROUND: The subject property is located at 2705-2719 Farabaugh Lane. The applicant is proposing to rezone the existing developed 30,000 square foot property to allow uses that are not currently allowed in the B-3 Zone District. Specifically, the applicant would like to lease a portion of the existing building for marijuana cultivation facility. The surrounding area and existing uses on the property are consistent with the proposed Zone District. Staff recommends that if the rezoning is approved it shall be subject to the following conditions: 1. A rezoning exhibit and site plan shall be provided in dwf format. 2. A landscape plan, bringing the landscape setback areas into compliance with Section 17-4-7 of the Pueblo Municipal Code, shall be provided. Landscaping must be installed within a one (1) year period after the rezoning approval. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their August 13, 2014 Regular Meeting, voted 2-3 to recommend approval with Commissioners Lucas, Seybold, and Webb dissenting, denial resulting in a of the request. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance, the current zoning would remain.
