HomeMy WebLinkAbout08775ORDINANCE NO. 8775 AN ORDINANCE APPROVING AND RATIFYING FEDERAL AVIATION ADMINISTRATION (FAA) AIP GRANT AGREEMENT NO. 3-08-0046-034-2014 FOR FUNDS IN THE AMOUNT OF $2,310,000 TO REHABILITATE TAXIWAY D AND A PORTION OF THE AIRCRAFT PARKING APRON AT THE PUEBLO MEMORIAL AIRPORT AND BUDGETING AND APPROPRIATING $2,314,211 TO CAPITAL PROJECT NO. AP1402-TAXIWAY D REHAB WHEREAS, the City of Pueblo has received a Grant Agreement from the Federal Aviation Administration (FAA) for the rehabilitation of Taxiway D and a portion of the aircraft parking area at the Pueblo Memorial Airport; and WHEREAS, a Colorado Department of Transportation-Aeronautics Division Grant was accepted by the City on March 24, 2014 to assist the City with the matching funds for this project; and WHEREAS, funds need to be budgeted and appropriated; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Grant Agreement between the City of Pueblo, a Municipal Corporation, and the Federal Aviation Administration (FAA) making available $2,310,000 in federal funds to rehabilitate Taxiway D and a portion of the aircraft parking apron at the Pueblo Memorial Airport, is hereby accepted and approved, and Resolution No. 13048 approved on September 8, 2014 is hereby ratified. SECTION 2. Funds are hereby budgeted and appropriated to Capital Project AP1402-Taxiway D Rehab from the Federal Aviation Administration grant in the amount of $2,310,000. Funds in the amount of $4,211 are hereby transferred from Capital Project CIAN18- Airport Grants to Capital Project AP1402-Taxiway D Rehab. SECTION 3. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance and the Grant Agreement to effectuate the transactions described therein. SECTION 4. This Ordinance shall become effective immediately upon final passage and approval. AP1402- TAXIWAY D REHAB SUMMARY: Attached is an Ordinance approving and ratifying a FAA grant agreement for the rehabilitation of Taxiway D and a portion of the aircraft parking apron at the Airport. PREVIOUS COUNCIL ACTION: City Council approved Resolution No. 12903 on February 24, 2014 authorizing the filing of an application for Federal assistance from the FAA to rehabilitate Taxiway D and a portion of the aircraft parking apron at the Pueblo Memorial Airport. City Council also approved Ordinance No. 8708 on March 24, 2014 accepting a Colorado State of Aeronautics grant to fund 2.5% of this project. On April 14, 2014, City Council approved Ordinance No. 8725 that established Project AP1402-Taxiway D Rehab and budgeted the State grant funds and the City’s matching funds into the project. BACKGROUND The pavement on Taxiway D and the associated apron area needs to be rehabilitated. This project is on the Airport’s CIP with both the Federal and State governments. The FAA is requiring the grant be accepted and executed by the City by September 9, 2014 in order for the grant to be valid. A Resolution is going before City Council on this agenda that will accept and approve the grant but this Ordinance is also being submitted to City Council for first reading to ratify the Resolution and to budget the grant funds into Project AP1402-Taxiway D Rehab. FINANCIAL IMPLICATIONS: The total project is $2,431,579. The Federal grant is for $2,310,000. The State and City matching funds were originally based on an estimated project cost of $2,263,157 and the State issued a grant for $56,578 with the City’s match being $56,579. Based on the Federal grant, the State’s portion should be $60,789 and City’s portion should be $60,790. The State has agreed to take an amendment to the Colorado Aeronautical Board asking for any additional funds, if needed, for the project after the Federal grant has been issued and accepted. The additional cost to the State and City will be $4,211. Federal funds in the amount of $2,310,000 will be budgeted to Project AP1402 and the City’s matching fund increase will be transferred from Capital Project CIAN18-Airport Grants to Project AP1402. BOARD/COMMISSION RECOMMENDATION: None STAKEHOLDER PROCESS: The project will only close small portions of the airport at any one time. Access will be provided for pilots wanting to use the facility and there should be minimal interference with any of the businesses on the Airport. ALTERNATIVES: If City Council approves and accepts the grant under the Resolution, the City will be responsible for the grant and the Federal government will expect the City to complete the project. If the Resolution is approved, then this Ordinance will need to be approved to budget the grant funds into the project. However, if City Council does not approve the Resolution, then this Ordinance will be pulled from the agenda. RECOMMENDATION Approval of this Ordinance. Attachments: None
