HomeMy WebLinkAbout13049 RESOLUTION NO. 13049 A RESOLUTION APPOINTING MEMBERS TO THE RETAIL MARIJUANA LICENSING AUTHORITY BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 The following individuals are hereby appointed to the Retail Marijuana Licensing Authority for initial staggered terms expiring on the first day of July as follows: Robert James For a one-year term expiring July 1, 2015 Carla Flores For a two-year term expiring July 1, 2016 Mike Ferris For a three-year term expiring July 1, 2017 Deric Stowell For a four-year term expiring July 1, 2018 Theresa “Terry” Barnett For a four-year term expiring July 1, 2018 SECTION 2 The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Resolution to effectuate the policies and procedures described herein. SECTION 3 This Resolution shall become effective immediately upon passage and approval. Daff and Members of City Council CC: Sam Azad, City Manager VIA: City Clerk’s Office FROM: Gina Dutcher, City Clerk SUBJECT: A RESOLUTION APPOINTING MEMBERS TO THE RETAIL MARIJUANA LICENSING AUTHORITY SUMMARY: This Resolution appoints five initial members to the Pueblo Retail Marijuana Licensing Authority. PREVIOUS COUNCIL ACTION: None BACKGROUND: City Council passed and approved Ordinance 8750 on June 23, 2014 which added a new Chapter 11 to the Pueblo Municipal Code (PMC) relating to the licensing of retail marijuana, cultivation facilities, product manufacturers and testing facilities. Section 11-11-201 creates a Retail Marijuana Licensing Authority. The Board appointed by City Council to serve as the Authority shall consist of five (5) members, who shall be residents of the City. Five (5) members shall be initially appointed for staggered terms expiring on the first day of July as follows: one (1) member for a one-year term, one (1) member for a two-year term, one (1) member for a three-year term, and two (2) members for four-year terms. Thereafter, each member shall be appointed for a term of four (4) years. At the Board's first regular meeting and on the anniversary of the first meeting and each year thereafter, the Board shall appoint one (1) of its members to act as Chair of the Board. The City Council shall make an appointment for any unexpired term in the event a vacancy arises. Powers of the Authority are included in Section 11-11-203 PMC. Following an advertisement in the Pueblo Chieftain and an announcement on the City Clerk’s webpage seeking volunteers to serve on this Authority, applications were received from the following individuals, all residents of the City of Pueblo: Deric Stowell Daniel Muniz June Akeo Anthony “Mike” Guagliardo Rudolph Martinez Jeffrey Newcom Terry Barnett Terry Behrman Yvonne Lujan-Slak Seenyana Gibson Mike Ferris Xavier Quintana Doris Harrison Charles Pullaro Clara Fox Robert James Rita Gonzales Gary White James Oliver Carla Flores Josef Herrera FINANCIAL IMPLICATIONS: None BOARD/COMMISSION RECOMMENDATION: Resolution 13010 implemented an interview process for the applicants of the Retail Marijuana Licensing Authority. Council members Ami Nawrocki and Steve Nawrocki reviewed applications, interviewed the candidates, and recommend the following five individuals for appointment to the Retail marijuana Licensing Authority: Theresa “Terry” Barnett Deric Stowell Mike Ferris Robert James Carla Flores STAKEHOLDER PROCESS: None ALTERNATIVES: Council could remove the Resolution from the Agenda, request that the recruitment process be extended, and order the public notice for applications be republished in order to receive additional applications for consideration. RECOMMENDATION: Approval of the Resolution. It is the recommendation of the Council Interview Panel that a drawing of the top five applicants be held in order to determine the initial terms: One member for a one-year term One member for a two-year term One member for a three-year term Two members for four-year terms Thereafter, each member shall be appointed to four (4) year term.
