HomeMy WebLinkAbout08769ORDINANCE NO. 8769 AN ORDINANCE AMENDING THE FISCAL YEAR 2014 STAFFING ORDINANCE BY REVISING POSITIONS WITHIN THE WASTEWATER DEPARTMENT WHEREAS, it is necessary to revise the positions for the ultimate efficiency and functionality for the Wastewater Department; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter being deleted, underscore indicates matter being added) SECTION 1. The reclassification of the two existing Lift Station Operators positions to WW Utility Worker V positions is contingent upon and subject to final approval by the Civil Service Commission if such reclassification is appealed. The reclassification of the two existing Lift Station Operators positions to WW Utility Worker V positions shall become effective upon the date that such reclassification becomes final pursuant to Section 6-4- 5, P.M.C. The creation of an entry-level Water Reclamation Worker position and the abolishment of a WWTP Operation Manager position shall become effective immediately upon final passage and approval. Daff and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Gene Michael, Wastewater Director Marisa Pacheco, Human Resources Director SUBJECT: AN ORDINANCE AMENDING THE FISCAL YEAR 2014 STAFFING ORDINANCE BY REVISING POSITIONS WITHIN THE WASTEWATER DEPARTMENT SUMMARY: Attached is an Ordinance amending the authorized staffing for the Wastewater Department by converting the position of WWTP Operations Manager to an entry-level Water Reclamation Worker position. PREVIOUS COUNCIL ACTION: In December 2013, City Council approved the annual Staffing Ordinance for the 2014 fiscal year. BACKGROUND: The Wastewater Department intends to reorganize certain functions by transferring responsibility for lift station operation and maintenance from the Collection Division to the Treatment Division. This reorganization takes advantage of advanced electrical maintenance and troubleshooting skills that exist within the Treatment Division, as well as converting the lift station operation and maintenance functions to the same system used by other municipalities. The Wastewater Department requests to adjust its staffing in the Treatment Division by converting the WWTP Operation Manager position into an entry-level Water Reclamation Worker position. The new Water Reclamation Worker will assist both the Operations and Maintenance sections at the Water Reclamation Facility, allowing the staff to absorb the additional duties of lift station operation and maintenance. The result of this action will be no net increase in staffing because an authorized position is being converted. The Wastewater Department requests to adjust its staffing in the Collection Division by abolishing the Lift Station Operator classification, establishing a new WW Utility Worker V classification, and reclassifying the two existing Lift Station Operators as WW Utility Worker V’s. This reclassification will retain the two existing Lift Station Operators within the Collection Division, making sewer maintenance staff available and expanding the duties of these senior employees to improve training and quality control functions. The result of this action will be no net increase in staffing, salaries, or benefits. FINANCIAL IMPLICATIONS: Funding for the Lift Station Operator position was appropriated in the 2014 budget. The new WW Utility Worker V classification is at the same salary level as the Lift Station Operator classification, and both employees are at the top step on the pay scale, so there is no change in funding for the new classification. The pay scale for the entry- level Water Reclamation Worker position is lower than the pay scale for the WWTP Operations Manager position, so the conversion will be less costly in terms of salary and benefits. BOARD/COMMISSION RECOMMENDATION: The President of the Pueblo Association of Government Employees (PAGE) has signed the meet and confer agreement. STAKEHOLDER PROCESS: City Administration and members of the executive board of the Pueblo Association of Government Employees (PAGE) met on July 31, 2014 to discuss the proposal. Both parties agreed to the reclassification of the WW Lift Station Operator to a WW Utility Worker V position. ALTERNATIVES: The no-action alternative would leave responsibility for operation and maintenance of the lift stations with the Wastewater Collection Division, making access to the electronic expertise and mechanical repair capabilities in the Treatment Division inefficient. The no-action alternative also maintains the existing staffing shortage in the Collection Division, reducing the effectiveness of sanitary sewer maintenance and increasing the City’s liability for sanitary sewer overflows and backups. RECOMMENDATION: The Wastewater Department recommends approval of this Ordinance. PROPOSED MOTION: Attachments: Memorandum of Understanding MEMORANDUM OF UNDERSTANDING This Memorandum of Understanding is entered into this /d y of Aka ,2014 by and between Pueblo Association of Government Employees("Union")and Pueblo,a Municie 1 Corporation ("City"). The parties stipulate, acknowledge and agree as follows: I. Permanent and substantial changes are being made by the City to the two positions in the Classification Wastewater Lift Station Operator. Kerry Sabott and Gary Romero ("Incumbents") currently occupy these positions. The new classification to which the City intends on reclassifying the position is the Classification"Wastewater Utility Worker V"(the "Reclassification"). A copy of the class for"Wastewater Utility Worker V" title is attached hereto and labeled Exhibit 1. 2. If the Reclassification is approved and becomes final, the City Manager may appoint the Incumbents pursuant to Section 6-8-4, P.M.C., and the Union agrees to waive any and all conflicting requirements within Article 7 of the labor agreement between the Union and City including any obligation to create or appoint from the eligible list for the classification "Wastewater Utility Workers" and with respect to the Reclassification. It being the understanding and agreement of Union and City that the appointment of the Incumbents to the Classification "Wastewater Utility Worker V" shall not in any manner be subject to appeal, grievance or arbitration. 4.
