AN ORDINANCE VACATING A PORTION OF WEST 12TH
STREET, A PORTION OF THE ALLEY BETWEEN WEST
11TH STREET AND WEST 12TH STREET, AND REPEALING
ORDINANCE NO. 8736

On May 12, 2014, City Council approved Ordinance No. 8736 which provided for mm o

a vacation of specific rights-of-way associated with the West 11th Street Bridge
Replacement Project. As approved, Ordinance No. 8736 does not contain the standard o o«o

language necessary to properly affect the right-of-way vacation. Ordinance No. 8736 is

hereby repealed.
SECTION 2.
The following described streets and alleys:
A PORTION OF A 16 FOOT WIDE ALLEY IN BLOCK 20 AND A
PORTION OF W 12TH STREET, IN ADEE, CHAMBERLIN AND WILEYS
SUBDIVISION, LOCATED IN THE SOUTHWEST QUARTER OF
SECTION 26, TOWNSHIP 20 SOUTH, RANGE 65 WEST OF THE 6TH
P.M. CITY OF PUEBLO, COUNTY OF PUEBLO, STATE OF
COLORADO.
VACATION A:
COMMENCING AT THE NORTHWEST CORNER OF LOT 8, BLOCK 20,
ADEE, CHAMBERLIN AND WILEY'S SUBDIVISION SAID POINT ALSO
BEING ON THE WEST LINE OF SAID SUBDIVISION, THENCE EAST
ALONG THE NORTH LINE OF LOT 8 A DISTANCE OF 18.94 FEET
PLUS OR MINUS TO THE POINT OF BEGINNING, THENCE EAST
ALONG THE NORTH LINES OF LOTS 8, 9, AND A PORTION OF LOT
10, BLOCK 20 A DISTANCE OF 50.00 FEET, THENCE NORTH A
DISTANCE OF 40.00 FEET, THENCE WEST A DISTANCE OF 50.00
FEET, THENCE SOUTH A DISTANCE OF 40.00 FEET TO THE POINT
OF BEGINNING. SAID VACATION INCLUDES A 20.00 FOOT
RESERVATION EASEMENT FOR PUBLIC UTILITIES IN THE
NORTHERLY HALF OF SAID VACATION.
SAID VACATION CONTAINING 2,000 SQUARE FEET, OR 0.045 ACRES

SECTION 3.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of this Ordinance to effectuate the policies and
procedures described herein.
SECTION 4.
This Ordinance shall become effective immediately upon final passage and
approval.

SUMMARY:

To facilitate the West 11 Street Bridge Replacement Project, staff requests the
thth
vacation of a portion of West 12 Street and a portion of the alley between West 11
th
Street and West 12 Street.
PREVIOUS COUNCIL ACTION:
On May 12, 2014 City Council passed Ordinance No. 8736, which will be repealed with
this Ordinance.
BACKGROUND:
On May 12, 2014, City Council approved Ordinance No. 8736 which provided for a

vacation of specific rights-of-way associated with the West 11 Street Bridge
Replacement Project. As approved, Ordinance No. 8736 does not contain the standard
language necessary to properly affect the right-of-way vacation.

The proposed West 11 Street Bridge Replacement Project will make the current
access to the Bethlehem Square Apartments’ southeast parking lot inaccessible. The
th
City proposes to construct an alternative access extending south from the West 12
Street right-of-way.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their March 12, 2014 Regular Meeting, voted
6-0 to recommend approval with Commissioner Burrer absent.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission
Public Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
Denial of this Ordinance would result in leaving the current Ordinance No. 8736 in effect
that does not contain the necessary language to legally describe the area of the
vacation.
RECOMMENDATION:
Approval of the Ordinance.
