STREET AND RESERVING A TWENTY FOOT WIDE UTILITY EASEMENT

Attached is a copy of the plat reflecting the portion of West 12 Street and a portion of the alley

between West 11 Street and West 12 Street that the City of Pueblo wishes to vacate.
PREVIOUS COUNCIL ACTION:
An Ordinance Accepting a Grant and entering into a contract with CDOT.
A Resolution to Award a Design Contract to URS Corporation.
BACKGROUND

The proposed West 11 Street Bridge Replacement Project will make the current access to the
Bethlehem Square Apartments southeast parking lot inaccessible. The City proposes to

construct an alternative access extending south from the West 12 Street right-of-way.

The portion of West 12 Street and the portion of the alley located between West 11 Street
th
and West 12 Street are required to be vacated to provide land for the proposed alternative
parking lot access. See attached Exhibit “A” for location.
A related action to transfer a deed of City property to Lucky Star LP, LLLP, (dba: Bethlehem
Square Apartments), is concurrent with passage of this Ordinance.
Also attached is the Street and Alley Vacation Plat.
FINANCIAL IMPACT
None.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission at their March 12, 2014 meeting voted 6-0 to recommend
approval with Commissioner Burrer absent.
STAKEHOLDER PROCESS:
The City of Pueblo met with representatives of Lucky Star LP, LLLP, (dba: Bethlehem Square
Apartments). The same representatives were in attendance at the March 17, 2014 City Council

Work Session presentation concerning the West 11 Street Bridge Replacement project and
proposed land transfer to allow the construction of the proposed new parking lot access.
ALTERNATIVES:
Denying this Ordinance would result in the City of Pueblo being unable to proceed with the
associated bridge replacement project.
PROPOSED MOTION:
This Ordinance will be placed on the April 28, 2014 Consent Agenda for First Presentation and
on the May 12, 2014 Regular Agenda for Final Presentation and Public Hearing.

BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.

The proposed West 11 Street Bridge Replacement Project will make the current access
to the Bethlehem Square Apartments southeast parking lot inaccessible. The City proposes to

construct an alternative access extending south from the West 12 Street right-of-way.
SECTION 2.

The portion of West 12 Street and the portion of the alley located between West 11
th
Street and West 12 Street are required to be vacated to provide land for the proposed
alternative parking lot access.
SECTION 3.
th
If the West 11 Street Bridge Replacement project is canceled for any reason, the lands
vacated within this Ordinance shall be deeded to the City of Pueblo within 90 days at no cost to
the City.
SECTION 4.
The officers and staff of the City are directed and authorized to perform any and all acts
consistent with the intent of this Ordinance and the contract to effectuate the transactions
described therein.
SECTION 5.
This Ordinance shall become effective immediately upon passage and approval.
