HomeMy WebLinkAbout12963RESOLUTION NO. 12963 A RESOLUTION ACCEPTING A BARGAIN AND SALE DEED FROM WL ENTERPRISES, INC., FOR THE DILLON DRIVE/I-25 INTERCHANGE PROJECT WHEREAS, the City of Pueblo, a Municipal Corporation, proposes to construct the south half of a split-diamond interchange at Dillon Drive which requires real estate to construct the project; and WHEREAS, the said real estate is being donated from WL ENTERPRISES, INC., to the City of Pueblo, a Municipal Corporation, for the purpose of constructing the proposed interchange project; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Bargain and Sale Deed from the WL Enterprises, Inc. (Grantor) to the City of Pueblo, a Municipal Corporation (Grantee), a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved, and the President of City Council is authorized to execute and deliver the Bargain and Sale Deed in the name of the City. SECTION 2. The City Clerk is directed to cause said Bargain and Sale Deed to be recorded in the office of the Pueblo County Clerk and Recorder. SECTION 3. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Resolution to effectuate the policies and procedures described herein. SECTION 4. This Resolution shall become effective immediately upon passage and approval. PREVIOUS COUNCIL ACTION: An Ordinance Accepting a Grant and entering into a design service contract with SEH, Inc. A Resolution to increase the design service contract with SEH, Inc. BACKGROUND The proposed Dillon Drive / I-25 Interchange Project requires a realignment of Dillon Drive between I-25 and Elizabeth Street and property on the east side of I-25 for the extension of Dillon Drive. Additionally, the project requires water quality facilities for Stormwater runoff. WL Enterprises, Inc. has agreed to donate all of the land under their control that is required for the project. Attached is a copy of the Bargain and Sale Deed. FINANCIAL IMPLICATIONS: None. BOARD/COMMISSION RECOMMENDATION: None. STAKEHOLDER PROCESS: The City of Pueblo has had several meetings with representatives of WL Enterprises, Inc. as well as two public meetings for the project. ALTERNATIVES: Denying this Resolution would result in the City of Pueblo being unable to proceed with the associated interchange project. RECOMMENDATION: Approval of this Resolution.
