Daff and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Mark Lovin – Aviation Department SUBJECT: AN ORDINANCE BUDGETING AND APPROPRIATING FUNDS IN THE AMOUNT OF $153,890 AND INCREASING THE TOTAL AMOUNT IN CAPITAL PROJECT NO. AP1301-FUEL FARM CONTAINMENT TO $353,890 SUMMARY: Attached is an ordinance budgeting and appropriating Colorado Department of Transportation- Aeronautics Division grant funds and City matching funds to Capital Project No. AP1301-Fuel Farm Containment and increasing the total Project funding to $353,890. PREVIOUS COUNCIL ACTION: City Council passed and approved Resolution No. 12624 on March 25, 2013 accepting a State grant for funds to construct a secondary containment structure for the Fuel Farm at the Airport. On April 8, 2013, City Council passed and approved Ordinance No. 8580 establishing Capital Project No. AP1301-Fuel Farm Containment and budgeting and appropriating the State grant funds and the City’s matching funds to the project. An ordinance to approve the State grant is on this agenda for final presentation and Council action. BACKGROUND State regulations require all airport fuel farms to have a secondary containment system in place. The 2013 grant paid for part of the structure to be built but in order to finish the project more funding is necessary. FINANCIAL IMPLICATIONS: The total increase to the project will be $153,890. The State Grant is for $138,501 and the City’s matching funds are $15,389. The City’s matching funds will be transferred from the following projects to Capital Project AP1301-Fuel Farm Containment: $4,936 from Project AP1102- Security Fence, $341 from Project AP1203-Ramp Reconstruction, and $10,112 from CIAN18- Airport Grants. BOARD/COMMISSION RECOMMENDATION: None STAKEHOLDER PROCESS: The project is necessary to meet State regulations. The businesses on the airfield have been informed of the construction and alternatives have been put in place for access to the fuel tanks that they lease. ALTERNATIVES: If City Council does not approve the State grant ordinance, this ordinance will be pulled from the agenda. If City Council does approve the State grant ordinance and does not approve this ordinance, the State’s funding for this project will go back to the State as it cannot be utilized for anything else and the City will be in violation of State regulations as the containment system will not be completed. RECOMMENDATION Approval of this Ordinance. PROPOSED MOTION: This Ordinance will be placed on the Consent Agenda as it is being presented for First Presentation, which sets the public hearing and orders the notice of the public hearing to be published. On April 14, 2014, the Ordinance will be placed on the Regular Agenda as it will be presented for Second and Final Presentation, which includes the public hearing and action by Council. AP1301- FUEL FARM CONTAINMENT TO $353,890 WHEREAS, the City of Pueblo has accepted a Grant Agreement from the Colorado Department of Transportation-Aeronautics Division in the amount of $138,501 to complete the construction of a Fuel Farm Containment structure; and WHEREAS, the City is required to match the grant funds by contributing $15,389 to the project; and WHEREAS, funds need to be budgeted and appropriated; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Funding for Capital Project No. 1301-Fuel Farm Containment is hereby increased to $353,890. SECTION 2. Funds in the amount of $138,501 are hereby budgeted and appropriated to Capital Project No. AP1301-Fuel Farm Containment from the Colorado Department of Transportation- Aeronautics Division grant. SECTION 3. Funds in the amount of $4,936 from Capital Project No. AP1102-Security Fence, $341 from Capital Project No. AP1203-Ramp Reconstruction, and $10,112 from Capital Project No. CIAN18-Airport Grants are hereby transferred to Capital Project No. AP1301-Fuel Farm Containment. SECTION 4. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance to effectuate the policies and procedures described therein.
