HomeMy WebLinkAbout08720 ORDINANCE NO. 8720 AN ORDINANCE AMENDING CHAPTER 5 OF TITLE VI OF THE PUEBLO MUNICIPAL CODE RELATING TO COMPENSATION OF UNCLASSIFIED PART-TIME EMPLOYEES (2014) BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter being deleted, underscoring indicates new matter being added) SECTION 1. Sections 18 and 19 of Chapter 5 of Title VI of the Pueblo Municipal Code are hereby amended to read as follows: [ 6-5-18. Temporary and intermittent workers. The following shall constitute the rate of pay for all temporary and intermittent workers. (Effective January 1, 2009) (Stagehands) During Showtime** HOURLY RATE (In and Out) $60.00$16.00 Carpenter $60.00 $16.00 Electrician, Propertyman, $60.00$16.00 Sound Operator, Spot Operator Wardrobe $16.00 Pieceworker and Riggers $16.00 Carloaders ** Shows are three hours in duration. Shows in excess of three hours will be prorated on the basis of the showtime rate. Rehearsals are the same as shows. Minimum call shows in: Four hours Minimum call shows out: Two hours Overtime: One and one-half the hourly rate for more than eight hours in one day, except that showtime shall not be considered overtime or be computed as any part of the regular eight-hour working day. ] [] 6-5-19. Reserved. SECTION 2. All payments made consistent with the amended pay schedule set forth in Section 1 for work performed prior to the effective date of this Ordinance are hereby ratified. SECTION 3. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance to effectuate the policies described herein. SECTION 4. This Ordinance shall become effective immediately upon final passage and approval. Daff and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Marisa Pacheco – Human Resources Department SUBJECT: AN ORDINANCE AMENDING CHAPTER 5 OF TITLE VI OF THE PUEBLO MUNICIPAL CODE RELATING TO COMPENSATION OF UNCLASSIFIED PART-TIME EMPLOYEES (2014) SUMMARY: The Code of Ordinances should be amended to reflect the 2014 wages for unclassified part- time employees and repeal outdated provisions relating to stagehands. PREVIOUS COUNCIL ACTION: None BACKGROUND: Section 6-5-18 titled, “Temporary and Intermittent Workers,” is repealed. The City of Pueblo no longer hires stagehands to operate Memorial Hall. The City of Pueblo has a management agreement in place with Global Spectrum Management, who performs this function on behalf of the City of Pueblo. Section 6-5-19 sets forth the rate of pay of part-time employees of the City and is updated to reflect the change in pay rate for 2014. Currently, the City of Pueblo follows Federal minimum wage guidelines and/or the State of Colorado minimum wage, whichever is greater. This provision is further relocated to Section 6-5-18 given the repeal of the former provisions above noted. FINANCIAL IMPLICATIONS: Funding for authorized temporary and part-time positions has been appropriated with the approval of the 2014 Budget Ordinance. BOARD/COMMISSION RECOMMENDATION: None STAKEHOLDER PROCESS: Not Applicable ALTERNATIVES: Without this Ordinance, the Code of Ordinances relating to compensation for part-time employees would be outdated and not consistent with Federal and State minimum wage guidelines. RECOMMENDATION: Approval of the Ordinance. PROPOSED MOTION: This Ordinance will be placed on the March 24, 2014 Consent Agenda for First Presentation, and on the April 14, 2014 Regular Agenda for Final Presentation and Public Hearing.
