HomeMy WebLinkAbout08714ORDINANCE NO. 8714 AN ORDINANCE CHANGING ZONING RESTRICTIONS FOR A PARCEL OF LAND GENERALLY LOCATED ON HAYHURST AVENUE NORTH OF FARABAUGH LANE FROM B-3, HIGHWAY AND ARTERIAL BUSINESS DISTRICT TO BP, BUSINESS PARK DISTRICT BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering a parcel of land generally located on Hayhurst Avenue north of Farabaugh Lane are hereby changed from B-3, Highway and Arterial Business District to BP, Business Park District and upon passage of this Ordinance, zoning restrictions affecting BP, Business Park District, shall apply to said property as follows: nd A parcel of land being Lot 3, Block 2, South Prairie Subdivision 2 Filing and the west one-half of Hayhurst Avenue between the centerline of said street and right-of-way line of Lot 3 located within a portion of the SW1/4 of the SW1/4 of Section 14, Township 21 South, Range 65 West of the Sixth Principal Meridian, County of Pueblo, State of Colorado. BEGINNING at the NW corner of Lot 3, Block 2, South Prairie Subdivision nd 2 Filing, according to the recorded plat thereof filed for record in book 1857, page 710 in the records of the Pueblo County Clerk and Recorder to the Point of Beginning; Thence S 898 57’ 31” E, a distance of 139.37 feet; Thence N 578 29’ 41” E, a distance of 57.35 feet, to the NE corner of Lot 3; Thence N 578 29’ 41” E, a distance of 30.00 feet to the centerline of Hayhurst Avenue; Thence S 328 30’ 19” E along the centerline of Hayhurst Avenue, a distance of 175.55 feet; Thence S 718 37’ 10” W, a distance of 30.94 feet to the SE corner of Lot 3; Thence S 718 37’ 10” W , a distance of 281.41 feet to the SW corner of Lot 3; Thence N 038 08’ 30” W, a distance of 200.00 feet to the point of beginning. Said parcel contains 1.03 acres more or less. SECTION 2. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of the Ordinance to effectuate the policies and procedures described herein. SECTION 3. This Ordinance shall become effective immediately upon final passage and approval. RECOMMENDATION The Planning and Zoning Commission, at their February 12, 2014 Regular Meeting, voted 4-0 to recommend approval with Commissioners Burrer, Kaufman, and Latka being absent. BACKGROUND The applicant is requesting to rezone 0.911 acres from B-3 (Highway and Arterial Business District) to BP (Business Park District). The subject property is located on the west side of Hayhurst Avenue, mid-block, approximately 200 feet north of the intersection with Farabaugh Lane. The applicant is proposing to rezone with the intention of expanding an existing mini-storage development from the north onto the subject property. FINANCIAL IMPACT None.
