HomeMy WebLinkAbout12915 RESOLUTION NO. 12915 A RESOLUTION TABLING FINAL ACTION ON THE PETITION FOR THE ANNEXATION OF THE AREA COMMONLY KNOWN AS SOUTHERN COLORADO CLINIC ANNEXATION AND DESCRIBED AS SOUTH OF HIGHWAY 50 WEST, NORTH OF THE YMCA COMMUNITY CAMPUS, AND EAST OF WILDHORSE ROAD FOR AN ADDITIONAL PERIOD OF NOT MORE THAN 180 DAYS BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Final action on the Petition is hereby tabled for an additional period of not more than one hundred eighty (180) days to September 29, 2014. SECTION 2. Upon receipt of the recommendation of the Planning and Zoning Commission, the City Council, without undue delay, shall make a final determination by Resolution whether the petition substantially complies with the applicable requirements of Section 31-12-107(1), C.R.S. and establish the date, time, and place the City Council will hold a public hearing to determine if the proposed annexation complies with Sections 31-12-104 and 31-12-105, C.R.S. or such parts thereof as may be required to establish eligibility for annexation. Daff and Members of City Council CC: Sam Azad, City Manager VIA: Gina Dutcher, City Clerk FROM: Steven Meier – Planning and Community Development SUBJECT: A RESOLUTION TABLING FINAL ACTION ON THE PETITION FOR THE ANNEXATION OF THE AREA COMMONLY KNOWN AS SOUTHERN COLORADO CLINIC ANNEXATION AND DESCRIBED AS SOUTH OF HIGHWAY 50 WEST, NORTH OF THE YMCA COMMUNITY CAMPUS, AND EAST OF WILDHORSE ROAD FOR AN ADDITIONAL PERIOD OF NOT MORE THAN 180 DAYS SUMMARY: Shall the City Council table final action on the petition for the annexation of the area commonly known as the Southern Colorado Clinic Annexation for an additional period of not more than 180 days? PREVIOUS COUNCIL ACTION: The Petition for Annexation was Filed on January 5, 2010. Resolution preliminarily determining that the Petition for Annexation is valid and tabling final action for not more than 180 days was passed and approved on November 28, 2011. Since this time, final action on the Petition has been extended by City Council five times. BACKGROUND: The Southern Colorado Clinic Annexation comprises 43.55-acres south of Highway 50 West, north of the YMCA Community Campus, and east of Wildhorse Road. This Resolution allows additional time for the City to complete an annexation agreement, the Planning and Zoning Commission to review the annexation petition, and tables any final action on the action petition for a period of not more than one hundred eighty (180) days. FINANCIAL IMPLICATIONS: None BOARD/COMMISSION RECOMMENDATION: The City Planning staff recommends that City Council approve tabling the final action up to an additional 180 days to allow time for completion of an annexation agreement and review by the City Planning and Zoning Commission. STAKEHOLDER PROCESS: None ALTERNATIVES: If the 180 day extension is not approved, the Southern Colorado Clinic Annexation Petition would become invalid and the applicant would have to start the petition process over. RECOMMENDATION: Approve the Resolution PROPOSED MOTION: This Resolution will be placed on the Consent Agenda. Attachments: Letter from Wm.
