A RESOLUTION APPROVING AN AGREEMENT
BETWEEN THE CITY OF PUEBLO, A MUNICIPAL
CORPORATION, AND BROWN AND CALDWELL, INC., TO
PROVIDE TREATMENT PROCESS DESIGN SERVICES
INCIDENT TO THE 2014 STATE NUTRIENT GRANT
PROGRAM FOR THE PUEBLO WASTEWATER
DEPARTMENT AND AUTHORIZING THE PRESIDENT OF
THE CITY COUNCIL TO EXECUTE SAME
WHEREAS, the Pueblo Wastewater Department operates a Water Reclamation
Facility providing biological nutrient removal; and
WHEREAS, compliance with Water Quality Regulation No. 85 requires
construction of further treatment processes; and
WHEREAS, the City accepted a State grant for construction of nutrient removal
facilities; and
WHEREAS, Brown and Caldwell, Inc. is the Consultant Engineer of Record and
is the most qualified to serve the Pueblo Wastewater Department; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
An Agreement, a copy of which is attached hereto and made a part hereof by
reference, after having been approved as to form by the City Attorney, by and between
the City of Pueblo, a Municipal Corporation, and Brown and Caldwell, Inc. to carry out
pilot testing, process design, and permitting for additional nutrient removal facilities is
hereby approved, subject to the conditions as set forth in said contract.
SECTION 2.
Work performed under this contract may include, but is not limited to, the
following items:
1. Project management and administration;
2. Pilot study;
3. Site Investigation;
4. Preliminary design and Basis of Design report;
5. Permitting;
6. Final Design;
7. Bid phase services;
8. Engineering services during construction;
9. Post-construction phase services; and
10. Supplemental services.
SECTION 3.
The President of the City Council is hereby authorized to execute said
Agreement on behalf of Pueblo, a Municipal Corporation, and the City Clerk shall affix
the Seal of the City thereto and attest the same.
SECTION 4.
Funds for work performed under this agreement shall be from the Sewer User
Fund Project No. WW1303.
SECTION 5.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of this Resolution and the attached agreement to
effectuate the transactions described therein.
SECTION 6.
This Resolution shall become effective immediately upon passage and approval.

Should the City Council approve an agreement to provide treatment process design
services, incident to the 2014 State Nutrient Grant Program, for the Pueblo Wastewater
Department to Brown and Caldwell, Inc.?
RECOMMENDATION
Approve this Resolution.
BACKGROUND
The Wastewater Department operates the James R. DiIorio Water Reclamation Facility
which is subject to nutrient removal requirements. The City of Pueblo accepted a grant
from the State of Colorado in the amount of $1,080,000 in October 2013 via Ordinance
No. 8647. The grant requires the Wastewater Department to construct facilities to
control nutrients in accordance with the requirements of Colorado Water Quality
Regulation #85 by May 2016. This agreement between the City and Brown and
Caldwell, Inc. authorizes Brown and Caldwell, Inc. to carry out pilot testing, process
design, and permitting for additional nutrient removal facilities. Brown and Caldwell, Inc.
was selected as the Consulting Engineer of Record via Resolution No. 12828, approved
on November 25, 2013.
FINANCIAL IMPACT
Funds for this project are available from Colorado Nutrient Grant Program and have
been appropriated from the Sewer User Fund Project No. WW1303.
