A RESOLUTION APPROVING A PROFESSIONAL
ENGINEERING SERVICES AGREEMENT IN AN AMOUNT
NOT TO EXCEED $29,812.00 TO MATRIX DESIGN
GROUP, INC., FOR PROJECT NO. 12-040 (SW1003)
FOUNTAIN CREEK WATER QUALITY, AND
AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO
EXECUTE SAME
WHEREAS, the City of Pueblo maintains a side detention facility along Fountain

Creek at 40 Street and Dillon Drive; and
WHEREAS, a 400-foot section of the right bank of Fountain Creek requires
stabilization to protect the side detention facility; and
WHEREAS, the City has selected Matrix Design Group, Inc., to provide
professional engineering services for revetment protection design; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Agreement for Professional Engineering Services by and between Pueblo, a
Municipal Corporation, and Matrix Design Group, Inc., a true copy of which is attached
hereto and incorporated herein by reference (the “Agreement”) having been approved
as to form by the City Attorney, is hereby approved.
SECTION 2.
The President of City Council is hereby authorized to execute the Agreement in
the name and on behalf of the City and the City Clerk is directed to affix the seal of the
City thereto and attest same.
SECTION 3.
Funds for payment for professional services under said Agreement in an amount
not to exceed $29,812 shall be paid from appropriated funds budgeted in the City’s
2014 Budget from the Stormwater Enterprise Fund. Additional funds of $10,000 will be
transferred from Stormwater Project No. SW1499 – Projects To Be Determined.
SECTION 4.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of this Resolution and the attached agreement to
effectuate the transactions described therein.
SECTION 5.
This Resolution shall become effective immediately upon passage and approval.

Should the City Council approve an agreement in an amount not to exceed $29,812 with Matrix
Design Group, Inc., for professional services associated with Fountain Creek Water Quality in
specific, bank stabilization at the side detention facility?
RECOMMENDATION
Approval of Resolution.
BACKGROUND

The City of Pueblo Stormwater Utility has a side detention facility at 40 Street and Dillon Drive.
Flooding on Fountain Creek on September 13, 2013 caused severe erosion on the west bank
near said side detention facility. The repair of this section of embankment is necessary to
prevent damage to the existing detention pond and adjacent neighboring properties. The City
Stormwater maintenance field crew provided a temporary repair during the stormwater off-
season. A permanent repair is now required. Matrix Design Group will provide professional
engineering services in coordination, survey, design, plans preparation, and pre-project
permitting of revetment protection options along an approximately 400-foot section of the west
bank of the Fountain Creek. Matrix Design Group was selected from the City’s 2012 - 2014 pre-
qualified list of professional consultants for stormwater capital improvement projects. They have
the experience; expertise; and hydrology and hydraulic data for the Fountain Creek necessary
for this work.
A copy of the agreement with Matrix Design Group is attached.
FINANCIAL IMPACT
Funds for Project No. 12-040 (SW1003) Fountain Creek Water Quality, engineering services for
Fountain Creek bank stabilization at the side detention facility are available from the Stormwater
Enterprise Fund. Additional funds in the amount of $10,000 will be transferred from monies
approved in the 2014 Budget, SW1499, Projects To Be Determined.
