LT1405, BUDGETING AND APPROPRIATING $12,274.46 FOR SAID PROJECT, TRANSFERRING $838.10 FROM PROJECT NO. LT0806 – POOL REPAIR, $4,092 FROM PROJECT NO. LT1006 – KIDDIE RIDE ENHANCEMENTS, $7,025.87 FROM PROJECT NO. LT1008 – ICE ARENA CONCESSION EQUIPMENT, AND $318.49 FROM PROJECT NO. LT1117 – WILDHORSE CREEK TRAILHEAD RELOCATION TO PROJECT NO. LT1405 ISSUE Should City Council establish the Arkansas River Habitat Valuation Project No. LT1405, budget and appropriate $12,274.46 for said project and authorize the transfer of funds from specific completed Lottery projects in the amount of $12,274.46? RECOMMENDATION Approval of the Ordinance. BACKGROUND This project budgets and appropriates funds that will be used for appraisal services to value properties that were donated by the State of Colorado, Pueblo Conservancy District and Evraz – Rocky Mountain Steel for the Arkansas River Legacy Project. A total of 273.87 acres of river habitat easements were granted to the City of Pueblo for the stream habitat improvements and access routes to the construction project. FINANCIAL IMPACT The funds to complete the appraisal of the donated property in the amount of $12,274.46 is being provided from remaining funds from completed Lottery fund projects. The value of the donated properties will be utilized as in-kind contribution to the project that will be used as the non-federal local share of the project. If the value of the donated property is not included as part of the non-federal share of the project, the City will be responsible for paying a cash amount estimated to be $200,000 for the 35% local project matching funds. ORDINANCE NO. 8699 AN ORDINANCE ESTABLISHING THE ARKANSAS RIVER HABITAT VALUATION PROJECT NO. LT1405, BUDGETING AND APPROPRIATING $12,274.46 FOR SAID PROJECT, TRANSFERRING $838.10 FROM PROJECT NO. LT0806 – POOL REPAIR, $4,092 FROM PROJECT NO. LT1006 – KIDDIE RIDE ENHANCEMENTS, $7,025.87 FROM PROJECT NO. LT1008 – ICE ARENA CONCESSION EQUIPMENT, AND $318.49 FROM PROJECT NO. LT1117 – WILDHORSE CREEK TRAILHEAD RELOCATION TO PROJECT NO. LT1405 WHEREAS, subject to the provisions of the Project Cooperation Agreement between the City of Pueblo and the U.S. Army Corps of Engineers related to the Arkansas River Fisheries Habitat Restoration Project, the value of property donated to said Project is authorized to be valued as in-kind contributions for the Project; and WHEREAS, properties were donated to said Project by the State of Colorado, Pueblo Conservancy District, and Evraz – Rocky Mountain Steel Mills; and WHEREAS, the appraised value of the donated properties is required to be completed in accordance with federal land acquisition requirements in order to be credited as in-kind contributions. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Capital Improvement Project No. LT1405 - Arkansas River Habitat Valuation Project is hereby established. SECTION 2. Funds in the amount of $12,274.46 are hereby budgeted and appropriated to the 2014 Capital Budget for said project. SECTION 3. Funds in the amount of $838.10 are transferred from Project No. LT0806 - Pool Repair to Project No. LT1405, for said Project. SECTION 4. Funds in the amount of $4,092 are transferred from Project No. LT1006 – Kiddie Ride Enhancements to Project No. LT1405, for said Project. SECTION 5. Funds in the amount of $7,025.87 are transferred from Project No. LT1008 – Ice Arena Concession Equipment to Project No. LT1405, for said Project. SECTION 6. Funds in the amount of $318.49 are transferred from Project No. LT1117 – Wildhorse Creek Trailhead Relocation to Project No. LT1405, for said Project. SECTION 7. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance to effectuate the transactions described herein. SECTION 8.
