ORDINANCE NO. 4757
AN ORDINANCE AMENDING SECTION 10, OF
CHAPTER 8 OF TITLE VI OF THE 1971 CODE OF
ORDINANCES OF THE CITY OF PUEBLO, AND
PARTIALLY REPEALING SUBSECTION (f) OF SECTION
6 OF CHAPTER 4 OF TITLE VI OF THE 1971 CODE
OF ORDINANCES OF THE CITY OF PUEBLO, RELATING
TO MEDICAL EXAMINATIONS AND HEALTH REQUIREMENTS
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, THAT:

SECTION 1.
Section 10 of Chapter 8 of Title VI of the 1971 Code of Ordinances
of the City of Pueblo is hereby amended to read as follows:
A medical examination shall be required as a
condition precedent to /and7 every initial appoint-
ment and to such 5romotional7 other appointments
as the Director or City Manager may /direct? designate.
/Examinations - shall be by the City physician,
or such physician as the City Manager may direct,
and shall be at the City's expense. Candidates shall
fill out such forms and answer such questions
as may he required by the examining physician.
Examinations shall cover such matters as the City
Manager may direct. Medical examinations shall
not be used as a factor in determining general
averages in examinations unless the Commission or
City Manager so directs with respect to a particular
examination. The examining physician shall determine
only whether the candidate is physically qualified
for the position applied for, and shall certify to the
Director that the candidate is or is not so qualified
on the basis of the duties of the position. Persons
with a physical handicap may be employed for certain
positions where such handicap will not interfere with the
duties of the position. In addition, the examining physician
shall report in writing any disease, physical deformity or physical
deficiency which might affect the ability of the applicant to
fulfill his duties.]
All such medical examinations shall be conducted by
such physician and in such manner and form as are established
by the Director with the approval of the City Manager, for the
purpose of determining the physical qualifications of a candidate
to perform the duties of the position, and shall be at the expense
of the City. Examination results shall be submitted to the Director
by written report, which shall include the opinion of the examining
physician as to the physical qualifications of the candidate to
perform the duties of the position, and a statement from the ex-
amining physician of any condition of the candidate which might
substantially affect performance of the duties of the position.
If an examination report discloses any such condition, the Commission
and the involved department head shall evaluate the condition in
relation to the duties of the position. Based upon such evaluation,
if the Commission determines that the candidate is otherwise qualified
and can perform the duties of the position with reasonable accomo-
dation, the Commission, in accordance with the requirements of Sec.
6 -1 -7 of the Code, may certify the candidate as eligible for
appointment.
SECTION 2.
The first paragraph of Subsection (f) of Section 6 of Chapter
4, of Title VI of the 1971 Code of Ordinances of Pueblo, Colorado,
is hereby repealed in its entirety.
SECTION 3.
This Ordinance shall become effective 'immediately upon final
