DESCRIPTION: Bennet Street and Ilex Street and certain Alley's, within .
Block 3 and 4, Wilson's Subdivision, according to the recorded plat m
thereof, filed for record May 27, 1907 at Reception No. 152286 in the ONS
records of the Pueblo County Clerk and Recorder, located within a portionoN
of the S 1/4 of Section 31, Township 20 South, Range 64 West of the .111
Sixth Principal Meridian, being more particularly described as follows: v

All of the 15' wide southeasterly Alley, within said Block 4, Wilson's
Subdivision, lying southwesterly and adjacent to the northeasterly line of
said Wilson's Subdivision, lying north of the northerly right-of-way line of
Ilex Street and lying east of the easterly right-of-way line of the 16' wide
north-south Alley.
That portion of Bennet Street lying north of the northerly right-of-way line
of Ilex Street and lying south of the northerly line of Lot 18, of said Block 4,
Wilson's Subdivision, if extended southwesterly.
All of the 16' wide east-west Alley, within said Block 3, Wilson's
Subdivision lying west of southwesterly right-of-way line of Bennett Street
and lying east of the easterly right-of-way line of the 16' wide north-south
Alley.
All of the 16' wide north-south Alley, within said Block 3, Wilson's
Subdivision, lying north of the northerly right-of-way line of Ilex Street and
south of the northerly right-of-way line of the 16' wide east-west Alley,
being adjacent to lots 1 through 6.
All of Ilex Street, lying east of the easterly right-of-way line of Santa Fe
Avenue and west of northeasterly line of Wilson's Subdivision.
DESCRIPTION: Ilex Street, Stanton Avenue, Moffat Avenue, and a
certain Alley within Block 3, Stanton and Snyder's Subdivision, according
to the recorded plat thereof, filed for record June 6, 1887 at Reception No.
23103 in the records of the Pueblo County Clerk and Recorder, located
within a portion of the NW 1/4 of Section 6, Township 21 South, Range 64
West of the Sixth Principal Meridian, being more particularly described as
follows:
All of Ilex Street, lying east of the easterly right-of-way line of Santa Fe
Avenue and west of easterly line of Block 4, of said Stanton and Snyder's
Subdivision, if extended northerly.

SECTION 2.
The vacation is approved with the condition that the water main in the current Ilex
Avenue must remain in place until such time that a replacement main is constructed.
With that main in place, the Board of Water Works will need to have access for repair
and maintenance.
SECTION 3.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of this Ordinance to effectuate the policies and
procedures described herein.
SECTION 4.
This Ordinance shall become effective immediately upon final passage and
approval.

ASSOCIATED WITH THE ILEX INTERCHANGE PROJECT AND GENERALLY
LOCATED EAST OF SANTA FE AVENUE AND NORTH OF JUNIPER STREET
ISSUE
Should City Council approve the proposed vacation of the unused alleys and roadways
associated with the Ilex Interchange Project and generally located east of Santa Fe
Avenue and north or Juniper Street?
RECOMMENDATION
The Planning and Zoning Commission, at their November 20, 2013 Regular Meeting,
voted 6-0 with Commissioner Burrer absent to recommend approval with the following
condition:
The water main in the current Ilex Avenue must remain in place until such time that a
replacement main is constructed. With that main in place, the Board of Water Works
will need to have access for repair and maintenance.
BACKGROUND
The applicant is proposing to vacate the alleys and streets that are platted adjacent to
the I-25 and Ilex Street Interchange. The applicant owns all of the adjacent parcels and
will use the area for the construction of I-25 and the associated interchange. The
portion of Bennet Street adjacent to Santa Fe Avenue will remain to provide access to
the rear of the Sam’s Carpet Warehouse building. During construction, there will be
several underlying platted lots which will not have access to a public street; however,
CDOT owns these lots and will ensure access to all remaining parcels once the Project
is complete. In addition, once the Project is complete and prior to selling any property,
CDOT will review their ownership to determine excess properties for possible disposal.
Any property sold will be required to be subdivided by the new owner prior to issuance
of a building permit.
