A RESOLUTION AUTHORIZING THE PRESIDENT OF
CITY COUNCIL TO SIGN A LETTER OF COMMITMENT
PROVIDING ASSURANCE THAT THE CITY OF PUEBLO,
A MUNICIPAL CORPORATION, REMAINS COMMITTED
TO ENTERING INTO A PARTNERSHIP WITH THE
COLORADO DEPARTMENT OF TRANSPORTATION
CONCERNING THE I-25 (ILEX TO 1ST STREET) AND US
50/SH 45 INTERCHANGE (WILLS TO PURCELL)
PROJECTS
WHEREAS, the City Council through Resolution No. 12716, approved on June
24, 2013, authorized the submission of joint applications with Pueblo County to the
Colorado Department of Transportation (CDOT) requesting the acceleration of funding
for construction projects related to Interstate 25 and US 50; and
WHEREAS, the City Council through Resolution No. 12756, approved on August
12, 2013, authorized the commitment of the City of Pueblo to accept ownership and
maintenance of CDOT owned roadways as local matching funds for applications
requesting state and federal transportation funding from the Responsible Acceleration of
Maintenance and Partnerships (RAMP) Program and other State and Federal
Transportation sources for highway construction and improvement projects on the
Interstate 25 and US 50 corridors; and
WHEREAS, the Transportation Commission is requiring that an appropriate
official of each local entity sign and submit a document giving assurance that the entity
remains committed to projects for which they received an award of funding under the
RAMP program; and
WHEREAS, a document has been prepared by CDOT for signature by the
President of the City Council consistent with the form requested by the Colorado
Transportation Commission; and
WHEREAS, The City Council fully supports and remains committed to the I-25
(Ilex to First Street) and US 50/SH 45 Interchange (Wills to Purcell) Projects; NOW
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
A Letter of Commitment to CDOT, a copy of which is attached and incorporated
herein and having been approved as to form by the City Attorney, assuring that the City
of Pueblo, a Municipal Corporation, remains committed to entering into a partnership
with CDOT concerning the I-25 (Ilex to 1st Street) and US 50/SH 45 Interchange (Wills
Boulevard to Purcell Boulevard) Projects is hereby approved.
SECTION 2.
The President of City Council is hereby authorized to execute and deliver the
Letter of Commitment on behalf of the City of Pueblo, a Municipal Corporation, and the
City Clerk shall affix the seal of the City thereto.
SECTION 3.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of this Resolution and the attached Letter of
Commitment to effectuate the transactions described therein.
SECTION 4.
This Resolution shall become effective immediately upon final passage.

ISSUE
Should City Council authorize the President of Council to sign a letter providing
assurance that the City of Pueblo, a Municipal Corporation, remains committed to
entering into a partnership with the Colorado Department of Transportation concerning

Boulevard) Projects?
RECOMMENDATION
Approval of the Resolution.
BACKGROUND
The Colorado Transportation Commission is requesting the communities who were
awarded RAMP Program accelerated project funding to provide a “Letter of
Commitment” confirming that the project scope, schedule, and budget developed by the
Colorado Department of Transportation (CDOT) for their RAMP Project is acceptable
and that the community intends to enter into an Intergovernmental Agreement (“IGA”)
with CDOT related to their specific Project. The City and Pueblo County submitted two
RAMP applications that have been approved by CDOT. These applications propose
accelerating local, Federal Highway Administration, and state transportation funds to

complete improvements to Interstate 25 between the Ilex Bridge structure and 1 Street
and within the US-50 West corridor between Wills Boulevard and 1/4-mile west of
Purcell Boulevard.
FINANCIAL IMPACT
Project funding that will be included in the future IGA for the two RAMP Projects
includes a total of $49.844 million of RAMP accelerated project funds and other state
and local funding that is more specifically broken down as follows:

$32 million in RAMP funding for the I-25 Project (Ilex Bridge to 1 Street)
●
$30.4 million for the US-50W Project including $17.844 million in RAMP funds, $6.8
million in CDOT Asset Management funds, $4.756 million in FASTER
Safety/Congestion Mitigation funds, and $1 million in CDOT Operational funds for
the US-50W Project (Wills to Purcell)
●
$1.2 million of City Underground Utility Funds provided by the City to Black Hills
Energy for installing existing overhead electrical utility lines that are adjacent to I-25
within the project area underground.
●
State FASTER Transit Funds in the amount of $726,180 are being allocated for
multi-modal improvements including the construction of the Park n’ Ride, transit
stop, and bike/pedestrian connection to the Thomas Phelps Creek Trail.
●
The City will assume the ownership and maintenance responsibilities for SH 227

Joplin Avenue between East 4 St and Santa Fe Avenue (US 50C) that is currently
owned and maintained by CDOT on a date that coincides with the completion of
RAMP projects, but no later than December 2017.
The City will appropriate and budget funds for the Projects that are approved for RAMP
project acceleration funding prior to approval of the IGA with the CDOT.

Commission Requirement. The purpose of this document is to satisfy the requirement
established by the Transportation Commission that applicants for Public - Public Partnership projects
confirm their commitment to the project. The RAMP Resolution adopted by the Transportation
Commission on October 17, 2013, provides in part:
BE 17'... RESOLVED that the Transportation Commission requires for each Public -
Public Partnership project on or before January 6, 2014, a project scope, schedule, and
budget developed by the Colorado Department of Transportation in the form and to the
level of detail specified by the Chief Engineer; and
BE 17' FURTHER RESOLVED that the Transportation Commission also required for
each Public - Public Partnership project on or before January 6, 2014, evidence, in a form
specified by the Chief Financial Officer, confirming a commitment by the applicant to the
project scope, schedule, and budget developed by the Department, including an
agreement to hold a public vote to authorize the local match by no later than April 8 if
such vote is necessary; and
BE IT FURTHER RESOLVED that the Chief Engineer may extend the January 6,
2014, deadlines to April 7, 2014, upon application for extension form any applicant or
CDOT Region Transportation Director for projects in a flood damaged area.
Project Scope, Schedule, and Budget Prepared by CDOT. The Colorado Department of
Transportation has prepared the required scope, schedule, and budget for this Public - Public Partnership
project. This scope, schedule, and budget is incorporated as Exhibit A of this document. Exhibit A
specifies the financial and other commitments of the City of Pueblo and identifies when it is reasonably
anticipated that such commitments will be provided or performed.
Changes in Project Costs. CDOT and the Local Agency Partner will assess at the Final Office
Review (FOR) the project budget to be contracted. An estimate over the Exhibit A amount will trigger a
reevaluation of the project as well as the project match. CDOT and City of Pueblo will engage in
negotiations to determine how and if the project moves to advertisement for construction, as well as the
project match. If a project is determined by CDOT to no longer be feasible or if an agreement cannot be
reached, CDOT will advise the Transportation Commission that the project is unable to be moved forward
and should be removed from the list of approved Public- Public Partnership projects. On a CDOT
administered project, any cost variance discovered after the Final Office Review (FOR) will be the
responsibility of CDOT. On a project administered by the Local Agency Partner, the CDOT contribution
will not increase after the Final Office Review. Any addition of a "betterment" at the request of the Local
Agency Partner is the responsibility of the Local Agency Partner.
If there is a cost savings regardless of who is administering the project or when the cost savings
occurs, the savings will be prorated.
Intergovernmental Agreement. An Intergovernmental Agreement will be completed and fully
executed prior to any CDOT expenditure other than the five percent of the total project cost for Fiscal
Year 2014 authorized in the RAMP Resolution for pre- construction expenditures unless an exception is
granted by the CDOT Chief Financial Officer. It is the policy of CDOT that the Intergovernmental
Agreements must be executed by June 30, 2014. Any change in the standard wording of the
Intergovernmental Agreement may delay the project and thus put the project in jeopardy.
Criteria for Approval of RAMP Local Commitments. The CDOT Chief Financial Officer has
issued the following criteria:
(1) Locals acknowledge receipt of CDOT estimated project cost and drawdown schedule and
confirm their ability to provide funding on the schedule.
(2) Resolution by city councils or county commissioners or signed commitments by city
managers constitute adequate funding reaffirmation by the local. Where ballot initiative or future budget
adoptions are required, locals are fully disclosing and committing to all necessary steps to ensure that it
will be on the ballot and/or receive budget consideration.
(3) Dollar amount of local commitment must align with dollar amounts of CDOT cost estimates.
(4) Locals cannot commit traditional (FHWA/FTA) federal funds.
(5) Where multiple locals are involved, commitments are required form all locals before approval
of funding commitment will be considered.
(6) IGAs already in place should meet the above criteria.
Evidence of the Continued Commitment by the City of Pueblo to the Project. As an officer
of the City of Pueblo, I confirm that appropriate officials of the City of Pueblo have reviewed and
considered Exhibit A which contains the scope, schedule, and budget developed by CDOT for the project
and the policy regarding changes in project cost stated in the body of this document.
I confirm that to the best of my knowledge I know of no reason why the City of Pueblo and
CDOT will not execute an Intergovernmental Agreement as specified in Exhibit B and based on the
scope, schedule, and budget contained in Exhibit A and the policy regarding changes in project cost stated

125 Ilex to 1 St in Pueblo
The Project is located in Pueblo and involves Interstate 25. The project removes and replaces a 900 foot
elevated portion of Interstate 25 between Ilex Street interchange and the 1st Street interchange being
called the 1 viaduct. The Project includes the reconstruction of the mainline 1 -25 in both the
northbound and southbound directions to accommodate three lanes of traffic in each direction, along
with constructing adequate shoulder widths which are currently, for the most part, non - existent. In
addition, the project will rebuild the highly substandard and steep ramps by lengthening the ramps and
the acceleration and deceleration lanes to meet AASHTO standards for curvature, site distance, mainline
merging and, ramp length. The Project also includes a noise wall on the east side of 125 south of 1 St;
retaining walls at various locations; and aesthetic improvements along 125 and under 125 at 1st Street,
Stanton, Gruma, Future Alan Hammel, and Phelps Creek.
Because this project is a design build, CDOT will add additional possible scope items that the Design
Build Team could include in the project if the budget allows (not to exceed the $32 million). These are
called Additionally Requested Elements (ARE) that CDOT is working with the City to be considered to be
added to the project are:
• A park -n -ride or ride share parking lot that includes a bus stop
• Various trail segments interconnecting existing City and County trails and roads in vicinity of
project
• Miscellaneous landscaping in the vicinity of the project
• Larger or more enhanced Water quality BMPs
• Widening of the SB 125 bridge over US50C (Santa Fe Dr.)
• Widening of the 125 bridge(s) over 1st St
• Drainage study
• Overlay of Santa Fe Ave from 15t to Santa Fe Drive
This work is being accomplished in conjunction with the Ilex viaduct bridge replacement and the
rehabilitation of the bridges. All this work is being done through a Design Build project and
expenditures will include design, ROW acquisitions, historical mitigations, hazardous materials
mitigation, utility relocations, permanent water quality features, and construction.

US 50 Wills to McCulloch
The Project is located between Pueblo and Pueblo West and involves Highway 50 from approximately
mile post 307.5 to 313.5. This project is design bid build (traditional contracting). The project will add a
third lane in the eastbound direction between Purcell Boulevard and Wills Avenue. The Project includes
the reconstruction of the mainline US -50 in the eastbound direction from Pueblo Boulevard to Wills
Boulevard and roadway widening from Purcell Boulevard to Pueblo Boulevard to accommodate three
lanes of traffic. In addition, the project will widen the existing structure to three lanes at Wild Horse
Creek, add permanent water quality features, improve the north bound to eastbound turn lanes at
McCulloch Boulevard and Purcell Boulevard and improve the eastbound US 50 to southbound Pueblo
Boulevard and northbound Pueblo Boulevard to eastbound US -50 ramps (these were the Operational
improvement RAMP application).
Local Commitment
Pueblo County and the City of Pueblo are partnering together for an in -kind cash match for both the US
50 West project and 1 -25 Ilex to 1st project for a total projects cost of $42,000,000 (See below for
financial break down). The local match commitments involve the devolution of 2 state highways within
City of Pueblo and Pueblo County. Those highways are SH227 and SH233. The City of Pueblo will take
ownership of SH 227 (Joplin Ave.) and the County will take ownership of SH233 (Baxter Road). The
devolution value will be the equivalent of the maintenance for 20 years of that road. The devolution
value of SH227 is $ 4,164,065 and the value of SH233 is $4,919,155. The City and County will take
formal responsibility for ownership and maintenance of SH227 and SH233 at a negotiated date in the
future to be determined prior to signing the Intergovernmental Agreement (IGA).
The City of Pueblo is also contributing an estimated $1,200,000 cash to the project for the purpose of
undergrounding an existing electric line on the Ilex to 15t project. The current electric line is overhead
and will need to be relocated due to the improvements with the project. The City will pay Black Hills
Electric Company the additional costs of placing the electric lines underground up to an amount not to
exceed $1.2 million. This commitment will be included in the future IGA. Total estimated match is
approximately 24 %.
