HomeMy WebLinkAbout08678Reception 2026912 01/22/2016 ORDINANCE NO. 8678 AN ORDINANCE APPROVING A SPECIAL AREA PLAN FOR MILLIGAN SUBDIVISION, A SPECIAL AREA PLAN WHEREAS, a request for a Special Area Plan for the Milligan Subdivision, a m Special Area Plan, has been submitted to the Planning and Zoning Commission for0 mom approval pursuant to Section 17-4-29 of the Pueblo Municipal Code; and £m C WHEREAS, the Planning and Zoning Commission after a public hearing found N ° and determined the objectives and requirements of said Section 17-4-29 can and will be met; and mm WHEREAS, the Planning and Zoning Commission has recommended the Nm W approval of the Special Area Plan for the Milligan Subdivision, a Special Area Plan; N NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Special Area Plan for: A portion of the S '/2 of the NE '/4 of the NE % of Section 27, T. 20 S., R. 65 W., of the 6th P.M., and being more particularly described as follows: Beginning at a point on the East line of said Section 27; said point being 210.00 feet South of the Northeast corner of the said S '/2 of the NE '/4 thence Westerly and at right angles to the East line of said NE '/4, a distance of 130 feet; thence Northerly and parallel to the East line of said NE '/4, a distance of 44 feet; thence Easterly, a distance of 130 feet to the East line of said NE '/4; thence South along the East line of said NE %, a distance of 44 feet to the point of beginning, And Beginning at a point on the East line of said Section 27, said point being 210 feet South of the Northeast corner of the said S '/ of the NE % of the NE'/; thence Westerly and at right angles to the East line of said NE 1/4, a distance of 130 feet; thence Southerly and parallel to the East line of said NE '/4, a distance of 50 feet; thence Easterly, a distance of 130 feet to the East line of said NE '/4; thence North along the East line of said NE Y4, a distance of 50 feet to the Point of Beginning, County of Pueblo, State of Colorado Said Parcel contains 0.28 acres more or less. attached hereto, is hereby approved. • SECTION 2. RECOMMENDATION The Planning and Zoning Commission, at their June 12, 2013 Regular Meeting, voted 4- 0 to recommend approval with Commissioners Burrer, Lucas, and Seybold being absent. BACKGROUND The Special Area Plan (SAP) for the Milligan Subdivision meets the requirements of Section 17-4-29 of the Pueblo Municipal Code. The land in question was annexed into the City of Pueblo through a large unnamed Westside annexation on August 23, 1965, with some homes in the areas having being built prior to annexation on unsubdivided parcels. The existing northern parcel measures only 44 feet wide which does not meet the R-2 Zone District Requirements of 50 feet. Mr. Milligan is requesting to subdivide two parcels for the purpose of constructing single family homes, the same type of development which surrounds the subject property. The Special Area Plan will contain two lots of just over 6,000 square feet and will meet all R-2 Zone District dimensional requirements except lot width. The SAP will allow the owner to utilize two lots rather than build on one large lot which would be out of character with the prevailing development pattern of the neighborhood. The Milligan SAP will have a 27 foot front yard setback instead of a 25 foot setback to accommodate a newly platted 10 foot gas utility easement at the front of the lot. The additional two feet of setback will not be out of character since the residence next door is an ‘alley house’ erected in 1950 and setback 74 feet from the front property line.
