HomeMy WebLinkAbout08673 ORDINANCE NO. 8673 AN ORDINANCE APPROVING AND ADOPTING THE CITY OF PUEBLO’S ANNUAL ACTION PLAN FOR THE YEAR 2014 FOR COMMUNITY DEVELOPMENT BLOCK GRANT AND HOME INVESTMENT PARTNERSHIP ACT FUNDS, AUTHORIZING THE PRESIDENT OF THE CITY COUNCIL TO SUBMIT THE APPLICATION TOGETHER WITH ALL REQUIRED AND NECESSARY CERTIFICATIONS, ASSURANCES AND DOCUMENTATION TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT AND APPROPRIATING AND BUDGETING CDBG AND HOME FUNDS THEREFOR WHEREAS, the City of Pueblo is designated as an entitlement city under the Housing and Community Development Act of 1974, and will receive Community Development Block Grant and HOME federal funds for fiscal year 2014; and WHEREAS, the City of Pueblo conducted a citizen participation process that included one public meeting within the city of Pueblo in addition to a public hearing before City Council to obtain the views of citizens, non-profit and neighborhood groups on the City’s housing and community needs; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The City Council hereby finds and determines that the City of Pueblo’s Annual Action Plan FY 2014 listing activities to be funded with CDBG and HOME federal funds -copies of which have been previously distributed to the members of the City Council and the original having been on file in the City Clerk’s Office for public inspection- has been developed so as to give maximum feasible priority to activities which will benefit low- to moderate-income families and aid in the prevention or elimination of slums and blight, is hereby approved, adopted and incorporated herein. SECTION 2. The President of the City Council is hereby authorized to submit, in the name of the City of Pueblo, the Application (SF-424) and the Annual Action Plan FY 2014, together with all required and necessary certifications, assurances and documentation to the U.S. Department of Housing and Urban Development for $1,239,064 in new Community Development Block Grant funds and $303,789 in new HOME funds. SECTION 3. Community Development Block Grant funds in the amount of $1,239,764, which includes, $700 in program income and HOME funds in the amount of $416,762.63, which includes $75,000 in estimated program income and the required program match, are hereby budgeted and appropriated for the activities in the amounts set forth in the Annual Action Plan FY 2014. As outlined in Attachment 1, herein included. Any increase in the CDBG funding will be apportioned within CD1401 - Program Administration and CD1411 –Minor Repairs Program. Any decreases in funding will automatically occur to the administration and public services cap, and then to other projects based on their scores. Increases to the HOME grant will occur as follows: 1- Activity HO1401 & HO1402–Administration, will be increased up to the 10% cap; 2- Activity HO1405– CHDO, will be increased to meet the 15% requirement; 3- Activity HO1403-Pueblo County Consortium, will be increased to meet the 20% grant share; 4- Remaining funds will go to HO1406–Rehab/Infill/New Construction/TBRA. Decreases to the HOME grant will be apportioned in the same order. The City Manager is authorized to transfer from the CDBG Contingency Fund authorized under Ordinance 7168, funds required to complete an approved project. SECTION 4. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance to effectuate the transactions described within the Action Plan. SECTION 5. This Ordinance shall become effective immediately upon final passage. The Plan contains the funding recommendations made by the Citizen’s Advisory Committee, and as amended by the City Council. RECOMMENDATION Approval of the Ordinance. BACKGROUND As an entitlement city, the City of Pueblo is required by HUD to complete an annual action plan for each of the years of the Consolidated Plan. This Action Plan and the accompanying documentation serve as the City’s application to HUD for the 2014 CDBG and HOME federal grants. This Action Plan is the fifth and final action plan under the 2010-2014 Five-Year Consolidated Plan. A public meeting was held to receive citizen input and to interview applicants. The recommendations of the Citizen’s Advisory Committee were presented to the City Council at the September 9, 2013, Work Session. During the Work Session the City Council requested that $100,000 in funding be moved from the “ADA Ramps-Citywide” activity to the “Demolition Program” activity, and asked Staff to seek public comment on this prospective action. Staff presented this proposed change to the ADA Advisory Committee in October. The Committee discussed the issue, voted and provided its comments to the proposed changes. The comment is incorporated into the 2014-2015 Action Plan under the comments section. A listing of the CAC recommendations that included the above change was published in The Pueblo Chieftain on October 4, 2013. The Plan was distributed to Council under separate cover and an original copy was on file at the City Clerk’s Office for public inspection. No other comments were received by the Department to date. FINANCIAL IMPACT The estimated funding being budgeted is as follows: 1- Community Development Block Grant (CDBG) $1,239,764. a. 2014 grant for $1,239,064; b. $700 in program income. 2- HOME Investment Partnership Act Grant (HOME) $416,762.63. a. 2014 grant for $303,789; b. $75,000 in program income. c. The HOME grant requires a 12% ($30,378.90) local match and that match is appropriated in the City’s 2014 Budget. The amount represents the City’s portion of the match requirement. The County is responsible for matching their 20% ($7,594.73) allocation.
