AN ORDINANCE CHANGING ZONING RESTRICTIONS
FOR A PARCEL OF LAND LOCATED WITHIN LOTS 37
AND 38, BLOCK 37, LAKE MINNEQUA ADDITION FROM
B-2, SUBREGIONAL BUSINESS DISTRICT TO CCN,
COMMERICAL CHARTER NEIGHBORHOOD ZONE
DISTRICT
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering a parcel of land located within Block 37, Lake
Minnequa Addition to the City of Pueblo are hereby changed from B-2, Subregional
Business District to CCN, Commercial Charter Neighborhood Zone District and upon
passage of this Ordinance, zoning restrictions affecting CCN, Commercial Charter
Neighborhood Zone District, shall apply to said property as follows:
Lots 37 and 38, Block 37 Lake Minnequa Addition, Amended according to
the recorded plat thereof.
TOGETHER WITH the east half of the Alley and the west half of Evans
Avenue adjacent to said Lots 37 and 38.
Said parcel contains 0.18 acres, more or less.
SECTION 2.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of the Ordinance to effectuate the policies and
procedures described herein.
SECTION 3.
This Ordinance shall become effective immediately upon final passage and
approval.

ISSUE
Should City Council approve a request to rezone the property from B-2, Subregional
Business District to CCN, Commercial Charter Neighborhood Zone District?
RECOMMENDATION
The Planning and Zoning Commission, at their July 11, 2012 Regular Meeting, voted 6-
0 to recommend approval with conditions. Subsequently, all conditions of approval
have been completed by the applicant.
BACKGROUND
The applicant proposes to rezone the subject 5,400 square foot property from B-2,
Subregional Business District to CCN, Commercial Charter Neighborhood Zone District
to facilitate the expansion of an existing restaurant. The property contains a 1,363
square foot structure, constructed as a bar around 1889, and has since been converted
to a restaurant. The property is located within one of the original “Charter
Neighborhoods” in Pueblo. In addition to the rezoning, the applicant has also applied
for a parking and landscape variance through the Zoning Board of Appeals. The
submitted plans conform to the requirements of the Pueblo Municipal Code and the
proposed CCN Zone District.
