HomeMy WebLinkAbout12810RESOLUTION NO. 12810 A RESOLUTION CONVEYING BY A QUITCLAIM DEED LOT 2, HISTORIC ARKANSAS RIVERWALK PROJECT, FILING THREE TO THE PUEBLO URBAN RENEWAL AUTHORITY, WITHIN PUEBLO, COLORADO AND AUTHORIZING THE PRESIDENT OF THE CITY COUNCIL TO EXECUTE SAME BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Quitclaim Deed, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved and accepted. SECTION 2. The President of the City Council is hereby authorized to execute the attached Quitclaim Deed on behalf of the City. SECTION 3. The City Clerk is directed to cause said Quitclaim Deed to be recorded in the office of the Pueblo County Clerk and Recorder forthwith. SECTION 4. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Resolution to effectuate the transactions described herein. SECTION 5. This Resolution shall become effective immediately upon final passage. RECOMMENDATION Approval of this Resolution. BACKGROUND The City and Pueblo Urban Renewal Authority (PURA) entered into an agreement on March 26, 2007, as per Resolution 10962, related to tax increment funds (TIF). Within the agreement, property is to be conveyed by both the City and PURA within Gateway Park (Parcel A), to be owned by the City; and a lot (Lot 2) for private redevelopment, to be owned by the Authority, after the completion of the Historic Arkansas Riverwalk Project, Filing Three Subdivision (HARP Phase III Property). On August 12, 2013, City Council approved said subdivision which was recorded on September 3, 2013. This Resolution conveys Lot 2, Historic Arkansas Riverwalk Project, Filing Three to the Authority as per the agreement. Riverwalk, Suite 410, Pueblo, CO 81003 (hereinafter referred to as "Grantee "): WITNESSESTH, that the Grantor, for and in consideration of the sum of TEN DOLLARS ($10.00), and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, has QUITCLAIMED, and by these presents does QUITCLAIM, unto the Grantee, his heirs, successors and assigns, all right, title and interest that the Grantor has in the real property, together with improvements, if any, situate, lying and being in Pueblo County, State of Colorado, described as follows: Lot 2, Historic Arkansas Riverwalk Project, Filing Three IN WITNESS WHEREOF, this Quitclaim Deed is executed by Grantor to be effective the day and year first above written.
