HomeMy WebLinkAbout08630ORDINANCE NO. 8630 AN ORDINANCE CHANGING ZONING RESTRICTIONS FOR A PARCEL OF LAND GENERALLY LOCATEDEAST OF PUEBLO BOULEVARD AND SOUTH AND WEST OF SPAULDING AVENUE FROM B-3, HIGHWAY AND ARTERIAL BUSINESS DISTRICT TO PLANNED UNIT DEVELOPMENT (PUD) BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering a parcel of landgenerally located east of Pueblo Boulevard and south and west of Spaulding Avenue are hereby changed from B-3, Highway and Arterial Business District to Planned Unit Development (PUD) and upon passage of this Ordinance, zoning restrictions affecting a Planned Unit Development (PUD), shall apply to said property as follows: A parcel of land in the W ½ of the SW ¼ of Section 15, Township 20 th South, Range 65 West of the 6 P.M. in the County of Pueblo and State of Colorado, being more particularly described as follows: Considering the portion of the East line of Lot 1, of Park West Business Campus, Filing No. 3 to bear S. 01°43’18” E. and all bearings contained herein being relative thereto. PARCEL NO. 1 B-3 TO S-3 Beginning at the southerly corner of Lot 1, Block 1 in Park West Business Campus, Filing No. 3 according to the recorded plat thereof as filed for record at Reception No. 1626947 in the Pueblo County records; thence, along the south line of said Lot 1 the following four courses, 1. N. 50°27’21” W. a distance of 88.68 feet, 2. N 56°57’00” W., a distance of 266.09 feet; 3. N. 64°55’48” W., a distance of 318.76 feet; 4. N. 40°35’03” W. a distance of 290.56 feet; thence N. 01°45’08” W. along the west line of said Lot 1, a distance of 196.15 feet, thence S. 50°25’33” E., a distance of 220.61 feet, thence S. 46°10’53” E., a distance of 326.56 feet, thence S. 64°47’27” E., a distance of 200.34 feet, thence S. 53°04’55” E., a distance of 194.70 feet, thence S. 45°51’21” E., a distance of 42.38 feet, thence S. 00°47’55” E., a distance of 154.86 feet to the Point of Beginning. PARCEL NO. 2 B-3 TO PUD Commencing at the southerly corner of Lot 1, Block 1 in Park West Business Campus, Filing No. 3 according to the recorded plat thereof as filed for record at Reception No. 1626947 in the Pueblo County records; thence, along the east line of said Lot 1 a distance of 692.75’ to the Point of Beginning; thence S. 89°12’05” W. a distance of 119.81 feet; thence N 01°43’18” W., a distance of 603.39 feet; thence N. 89°12’05” E., a distance of 806.94 feet to the centerline of Spaulding Avenue; thence S. 01°43’18” E along the centerline of Spaulding Avenue. a distance of 603.36 feet; thence S. 89°12’05” W. a distance of 687.13 feet to the Point of Beginning. SECTION 2. The rezoning is approved with the following conditions: 1. Prior to the issuance of any building permits for the property, PUD site plan must be submitted and approved by the Planning and Zoning Commission. 2. Provide a phasing plan per Section 17-8-6(1)j of the PMC prior to approval of the PUD Site Plan. SECTION 3. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of the Ordinance to effectuate the policies and procedures described herein. SECTION 4. This Ordinance shall become effective immediately upon final passage and approval. RECOMMENDATION The Planning and Zoning Commission, at their July 10, 2013 Regular Meeting, voted 5- 0 to recommend approval with the following conditions: 1. Prior to the issuance of any building permits for the property, PUD site plan must be submitted and approved by the Planning and Zoning Commission. 2. Provide a phasing plan per Section 17-8-6(1)j of the PMC prior to approval of the PUD Site Plan. BACKGROUND The subject property is located in the Park West Business Campus, across from the YMCA Community Campus. The applicant proposes to rezone the subject property from B-3, Highway and Arterial Business District to Spanish Peaks Health & Wellness Center PUD to facilitate the construction of an integrated health and wellness campus. As proposed, the PUD provides a new land use area listing specific permitted uses, standards, and performance standards. Three (3) Land Use Areas have been created with this PUD: 1. Planning Area-1 (PA-1) – Bistro Area, 2. Planning Area-2 (PA-2) – Maintenance Area, and 3. Planning Area-3 (PA-3) – Office and Site Area. The Land Use Table designates the uses allowed by right, conditionally, by review, and not permitted in each of these areas. In addition, the PUD Development Guide provides performance standards for the building and site architecture, outdoor lighting, signage, landscaping, and pedestrian access. FINANCIAL IMPACT None.
