HomeMy WebLinkAbout05470 1) r ORDINANCE NO. 5470 AN ORDINANCE AMENDING SECTION 29, CHAPTER 4, TITLE XVII OF THE 1971 CODE OF ORDINANCES RELATING TO SPECIAL AREA PLANS BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: (brackets indicate material being deleted and underscoring indicates material being added) Section 1. Subsections (k) and (o) and the first paragraph of Section 29, Chapter 4, Title XVII of the 1971 Code of Ordinances are hereby amended to read as follows: 17 -4 -29: SPECIAL AREA PLANS In any zone district after or in conjunction with approval of a subdivision plan, pursuant to Chapter 4, Title XII of these ordinances, for any contiguous land or land composed of two or more contiguous parcels, a plan may be submitted to the Planning and Zoning Commission which proposes the unique development of such land or the rehabilitation or redevelopment of an existing area with unique planning, building or ownership techniques not adequately recognized by the terms of this Title for the zone district in which the land is located. A public hearing shall be held as required by Chapter 6 of this Title. If [in the judgment of] the Planning Commission finds the following objectives and requirements can and will be satisfied, [then] the Commission [may approve such a plan and its approval shall be final and binding and the plan shall run with the land:] shall submit to City Council its recommendation on the proposed development within thirty days after the hearing is concluded. Such recommendation shall be to approve, approve with conditions or disapprove the plan. (k) After [approval] review of the plan by the Planning and Zoning Commission and final approval of the plan and subdivision plat by City Council building permits may be issued. No subsequent major change in the plan may be made unless [and until] prior approval is granted by the Commission and City Council after a public hearing. Subsequent [M]minor changes may be made by the Commission without a public hearing. No changes which would be incompatible with the subdivision plat upon which the Special Area Plan is located may be granted unless approved by City Council. (o) [Before any action shall be taken,] The applicant seeking [consideration] review of a Special Area Plan by the Planning and Zoning Commission shall deposit with the Finance Department a nonrefundable application before any action is taken fee of seventy -five dollars ($75.00). Upon payment of an additional nonrefundable ordinance fee of seventy -five dollars, the City Council shall consider the Special Area Plan application at a public hearing. Section 2. This ordinance shall become effective immediately upon final passage and approval.
