HomeMy WebLinkAbout05346Reception 812808 09/26/1986 ORDINANCE NO. 5346 AN ORDINANCE VACATING THE WEST 50 FEET OF THE EAST -WEST ALLEY LYING NORTH OF 1901 E. 15TH STREET BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. All of that alley in Block 135, East Pueblo Heights Subdivision, Second Filing, according to the recorded plat thereof, that lies south of Lots 1 and 2, and north of Lots 21 and 22 of said Block 135, City of Pueblo, Pueblo County Colo- rado, is hereby vacated, reserving, however, to the City of Pueblo and utility owners, the right at all times to repair, maintain, operate or replace existing utilities and sewer and water lines and mains, together with the right of ingress and egress to accomplish same. SECTION 2. The reservations set forth in Section 1 hereof shall, automatically terminate upon recording in the Pueblo County Clerk and Recorder's Office a veri- fied statement of the Director of Public Works of the City of Pueblo certifying that all utilities and sewer and water lines and mains existing in said vacated alley have been removed or abandoned. SECTION 3. The easement and right of way to the City for the purpose of utilities and public alley on, over and across the following described property is hereby accepted: An easement located in the City of Pueblo, Pueblo, County, Colorado to wit: An easement located in Lots 21 to 24, inclusive, Block 135, East Pueblo Heights Subdivision, Second Filing, according to the re- corded plat thereof, being more particularly described as follows: 800k 2398 ?AfF8 -4 An easement being 16 feet in width, 8 feet on each side of the following described centerline: Beginning at a point on the west line of said Lot 21 from which point the SW corner of said Lot 21 bears 87.83 feet; thence at an angle of 95 25' 00" to the riht, a distance of 36.23 feet; thence at an angle of 139. 14' 08" to the right, a distance of 61.36 feet to the point of Terminus, said point being a point on the north line of said Lot 24 from which the NE corner of said Lot 24 bears 13.82 feet. It being understood that the sidelines of said easements extend or shorten as necessary to intersect the sidelines of the preceeding and following courses, and the sideline of the first and last courses extend or shorten as necessary to intersect the property lines that the point of beginning and the point of terminus are a part of.
