ED1302 - GREENHORN DRIVE EXTENSION AND TRANSFERRING $1,200,000 FROM THE 1992-2016 SALES AND USE TAX CAPITAL IMPROVEMENT PROJECTS FUND INTO PROJECT ACCOUNT NO. ED1302 WHEREAS, Greenhorn Drive is the primary transportation corridor needed to serve the proposed St. Charles Industrial Park; and WHEREAS, Greenhorn Drive needs to be designed, and constructed; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Capital Project No. ED1302 - Greenhorn Drive Extension is hereby established. SECTION 2. Funds in the amount of $1,200,000 are hereby transferred from the 1992-2016 Sales and Use Tax Capital Improvement Projects Fund (the “Fund”) into Capital Project No. ED1302. SECTION 3. Funds encumbered by Resolution No. 11681 for the EDA grant match will be unencumbered and Project ED0904 – Greenhorn Drive Road Design will be closed and any funds appropriated therefor shall be transferred to reserves. SECTION 4. City Council finds and determines that the expenditure of a portion of the Fund for the design of Greenhorn Drive is needed to serve the proposed St. Charles Industrial Park and will further the location of job creating capital improvement project within the city and is within the intent and purpose of Ordinance No. 8509 establishing criteria, standards, rules, and regulations for the appropriation and expenditure of monies on deposit in the Fund. ED1302 ISSUE Should City Council authorize the use of the 1992-2016 Sales and Use Tax Capital Improvement Projects Fund in the amount of $1,200,000 and establish a new capital project to construct an extension of Greenhorn Drive? RECOMMENDATION Approval of this Ordinance. BACKGROUND On August 24, 2009, City Council approved Resolution No. 11681, authorizing the transfer of $2,500,000 from the 1992-2011 Sales and Use Tax Capital Improvement Projects Fund to be used as matching funds for a grant request to the U.S. Department of Commerce, Economic Development Administration (EDA) to fund the construction of the St. Charles Industrial Park Greenhorn Drive Extension Project. The proposed project would have extended Greenhorn Drive from its terminus to Lime Road. On October 13, 2009 City Council approved Ordinance No. 8090, establishing Capital Project No. ED0904 – FY 2009 Greenhorn Drive and Unnamed Roadway and Pavement Design and approving the transfer of $175,000 from the 1992-2011 Sales and Use Tax Capital Improvement Projects Fund into ED0904 for engineering services to design and construct the roadway. The EDA grant was not awarded to the City and the roadway extension / construction was not done. This project will extend Greenhorn Drive from its present terminus, recently constructed for access to the Federal Express site, to the southern limits of the Minnequa Industrial Park Third Filing. It will include that portion of Greenhorn Drive adjacent to the new Pewag Chain Manufacturing site including the driveways into the site. It will terminate at the Third Filing subdivision boundary with a temporary cul-de-sac and will not be extended to Lime Road. A Location and Vicinity Map are attached as an exhibit to this ordinance. This project will provide the geotechnical testing, pavement design and construction of the Greenhorn Drive Extension. Preparation of contract documents, contract administration and construction engineering services will be provided by the Public Works Department. FINANCIAL IMPACT Project ED0904 -Greenhorn Drive Road Design will be closed and any funds appropriated therefor shall be transferred to reserves. Project ED0904 currently has a remaining balance of $2,668,747.88.
