HomeMy WebLinkAbout12739RESOLUTION NO. 12739 A RESOLUTION RESCINDING RESOLUTION NO. 12708 AND AWARDING A CONTRACT TO CINTAS FIRE PROTECTION FOR PROJECT NO. 13-038 - ANNUAL FIRE PROTECTION SYSTEMS INSPECTION / TESTING / MAINTENANCE / MONITORING SERVICES IN THE AMOUNT OF $24,000 AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE THE SAME WHEREAS, Resolution No. 12708, passed and approved on June 24, 2013, awarded a contract to a vendor for Project 13-038; and WHEREAS, said vendor awarded the contract was unable to agree to the terms of the City’s standard services agreement; and WHEREAS, proposals for Project No. 13-038 have been re-examined; and WHEREAS, the proposal of Cintas Fire Protection of Colorado Springs, Colorado, was the alternate responsible bidder; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The contract between Cintas Fire Protection and the City of Pueblo for Project No. 13-038 – Annual Fire Protection Systems Inspection/Testing/Maintenance/ Monitoring Services (“Contract”), is hereby awarded to said bidder in the amount of $24,000. SECTION 2. The Purchasing Agent is hereby authorized to execute said Contract on behalf of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the same. SECTION 3. In addition to the amount of the bid set forth, as aforementioned, an additional amount as stipulated in this section is hereby established for contingencies and additional work. Contingencies and Additional Work . . . . $6,000 SECTION 4. Funds for said project shall be paid from account number 101-4010-430.30-03. The Wastewater Department will pay for the Private Fire Hydrant testing / inspection from account number 525-4110-432.30-01. SECTION 5. Resolution No. 12708 is hereby rescinded. SECTION 6. The officers of the City are directed and authorized to perform any and all acts consistent with the intent of this Resolution and the contract to effectuate the transactions described therein. SECTION 7. This Resolution shall become effective immediately upon passage and approval. RECOMMENDATION Approval of this Resolution. BACKGROUND The vendor originally awarded the contract for this project pursuant to City Council Resolution No. 12708, on June 24, 2013, was unable to agree to the terms of the City’s standard services agreement. As such, we must rescind the award and re-award to the next qualified vendor. The National Fire Protection Association (NFPA) Code requires annual independent inspection and testing for municipal public buildings having fire protection systems. This project also incorporates the annual inspection and testing of individual fire protection devices, such as fire extinguishers, smoke detectors, and ingress/egress devices. This contract now incorporates fire protection systems monitoring, that was previously accomplished separately by department. At the request of the Fire Department, this contract provides for the inspection and testing of the private fire hydrants located at the Wastewater Reclamation Facility (WWRF). FINANCIAL IMPACT Funds for this project will be paid from account number 101-4010-430.30-03. The Wastewater Department will pay for the Private Fire Hydrant testing / inspection from account number 525-4110-432.30-01.
