HomeMy WebLinkAbout08609ORDINANCE NO. 8609 AN ORDINANCE CHANGING ZONING RESTRICTIONS FOR A PARCEL OF LAND GENERALLY LOCATED AT TH THE NORTHWEST CORNER OF EAST 7 STREET AND MONUMENT AVENUE FROM B-2, SUBREGIONAL BUSINESS DISTRICT TO S-1, GOVERNMENTAL USE ZONE DISTRICT BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering a parcel of land located at the northwest corner th of East 7 Street and Monument Avenue are hereby changed from B-2, Subregional Business District to S-1, Governmental Use Zone District and upon passage of this Ordinance, zoning restrictions affecting S-1, Governmental Use Zone District, shall apply to said property as follows: A PORTION OF THE SOUTHWEST QUARTER OF SECTION 29, TOWNSHIP 20 SOUTH, RANGE 64 WEST,OF THE 6TH PRINCIPAL MERIDIAN, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: LOTS 27 THROUGH 34, BLOCK 121, AND THE FOLLOWING RIGHT- OF-WAY AND ALLEY: 1. THE NORTHERN 40 FEET OF 7TH STREET RIGHT-OF-WAY ADJACENT TO SAID LOTS 27 THROUGH 34; 2. THE WESTERN 30 FEET OF N. MONUMENT AVENUE RIGHT- OF-WAY FROM THE CENTERLINE OF 7TH STREET TO THE CENTERLINE OF THE ALLEY IN BLOCKS 121, AND 122; 3. THE SOUTHERN 8 FEET OF THE ALLEY ADJACENT TO SAID LOTS 27 THROUGH 34; ALL IN FLETCHER HILL ADDITION, CITY OF PUEBLO, COUNTY OF PUEBLO, STATE OF COLORADO, AS RECORDED UNDER BOOK 3, PAGE 26 OF THE RECORDS OF PUEBLO COUNTY. CONTAINING A CALCULATED AREA OF 38,594 SQ. FEET, OR 0.886 ACRES. SECTION 2. The zoning is approved with the following conditions: 1. Prior to the issuance of a building permit for the property, final construction plans must be submitted and approved by the City of Pueblo Departments of Transportation, Public Works, Stormwater, Wastewater and Planning and Community Development complying with all conditions of approval and all applicable Ordinances. 2. The Planning and Zoning Commission must review and approve the Development Plan Review prior to the property being developed. 3. A Special Use Permit from CDOT will be required for the installation of an Information (I-8) Library Sign. Unless otherwise noted, all conditions of approval must be addressed prior to the rezoning being recorded. SECTION 3. This Ordinance shall become effective immediately upon final passage and approval. RECOMMENDATION The Planning and Zoning Commission, at their April 10, 2013 Regular Meeting, voted 5-0 to recommend approval with the following conditions: 1. Prior to the issuance of a building permit for the property, final construction plans must be submitted and approved by the City of Pueblo Departments of Transportation, Public Works, Stormwater, Wastewater, and Planning and Community Development complying with all conditions of approval and all applicable ordinances. 2. BACKGROUND th The subject property is located at the northwest corner of East 7 Street and Monument Avenue. The applicant proposes to rezone the subject property from B-2, Subregional Business District to S-1, Governmental Use District to facilitate the construction of the East Side Library. Specifics of the structure have not been submitted as part of the rezoning project, but will be required to be submitted for review and approval by the Planning and Zoning Commission, prior to a building permit being issued.
