ORDINANCE NO. 8605
AN ORDINANCE VACATING THE DRAINAGE EASEMENT
LOCATED WITHIN LOTS 1, 3, AND 4, LAKE GARDENS
SUBDIVISION, 3 FILING
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The following described drainage easement:
That 35' Drainage Easement Tying within the northerly 35 feet of Lots 1, 3,
and 4 in Lake Gardens 3 Filing, according to the recorded plat thereof,
filed for record under Reception No. 477485 in the records of the Pueblo
County Clerk and Recorder.
EXCEPTING THEREFROM
The South 15 feet of the North 35 feet of said Lot 1, previously vacated by
the Easement Vacation Plat filed for record under Reception No. 1686168
in the records of the Pueblo County Clerk and Recorder.
Total Area to be vacated: 0.42 acres, more or less.
is hereby vacated.
SECTION 2.
This Ordinance shall become effective immediately upon final passage and
approval.

ISSUE
Should City Council approve the proposed vacation of the drainage easement located

within Lots 1, 3, and 4 Lake Gardens Subdivision, 3 Filing?
RECOMMENDATION
The Planning and Zoning Commission, at their May 8, 2013 Regular Meeting, voted 6-0
to recommend approval.
BACKGROUND
The Lake Gardens Subdivision, 3rd Filing was recorded in 1974. At the time, a 35’
wide drainage easement was platted to support a roadside ditch system due to a lack
of curb and gutter. Wagner Rents is relocating to this site from their former location
along I-25 due to the New Pueblo Freeway Project. The construction of their new
building triggers site improvements including the installation of curb and gutter making
the roadside ditch system obsolete and unnecessary within this area.
FINANCIAL IMPACT
None.
