A RESOLUTION AUTHORIZING THE CITY OF PUEBLO, A
MUNICIPAL CORPORATION, TO SUBMIT A GRANT
APPLICATION TO THE COLORADO DEPARTMENT OF
PUBLIC HEALTH AND ENVIRONMENT FOR ASSISTANCE
WITH THE COSTS ASSOCIATED WITH PLANNING,
DESIGN, CONSTRUCTION, AND/OR IMPROVEMENTS TO
COMPLY WITH STATE REGULATIONS AND
AUTHORIZING THE PRESIDENT OF THE CITY COUNCIL
TO EXECUTE THE SAME
WHEREAS, Regulation #85 of the Colorado Water Quality Control Commission
requires the City of Pueblo to meet effluent limits for nutrients; and
WHEREAS, the Colorado General Assembly has provided grant funding to assist
with Regulation #85 compliance; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The application for a State grant for assistance in complying with the
requirements of Regulation #85, a copy of which is attached hereto, is hereby approved.
SECTION 2.
The President of the City Council is hereby authorized to execute and deliver the
grant application in the name of and on behalf of the City of Pueblo to the Colorado
Department of Public Health and Environment, and the City Clerk shall affix the seal of
the City thereto and attest same.

ISSUE
Should the City Council authorize the filing of an application for a State grant from the
Colorado Department of Public Health And Environment to assist with the costs
associated with planning, design, construction, and/or improvements to comply with
State Regulation #85, related to nutrients management control?
RECOMMENDATION
Approve this Resolution.
BACKGROUND
In 2012, the Colorado Water Quality Control Commission established Regulation #85,
Nutrients Management Control, requiring larger public domestic wastewater treatment
facilities to meet effluent limits for nutrients. This regulation affects 46 municipal
wastewater treatment plants in Colorado, including Pueblo. In May 2013, the Colorado
General Assembly passed HB 13-1191, Nutrients Grant Fund to provide grant funding
to assist with Regulation #85 compliance. The grant application guidance and forms
became available on June 3, 2013. Applications for grant funding are due by July 3,
2013.
The grant program provides up to $80,000 for facility planning and design and up to
$1,000,000 for construction of facilities to meet the requirements of Regulations #85
and #32. Pueblo will require several new facilities to comply with Regulation #85 and
with the even more stringent nutrient standards that will take effect in 2022. These new
facilities include a fermenter, chemical feed stations for coagulants, and filters to
remove coagulated phosphorus. The Black and Veatch Corporation has provided a cost
opinion of $9,540,000 as a total cost to construct filtration for the primary purpose of
attaining compliance with a phosphorus effluent limit of 0.17 micrograms per liter, and
for the secondary purpose of improving ultra violet radiation transmittance to improve
the efficiency of disinfection. The grant will partially fund filter construction.
FINANCIAL IMPACT
Planning, design, and construction costs in excess of any grant award will be funded
through a State Revolving Fund (SRF) loan. There is no other significant financial
impact to the City as a result of this grant application.
