AN ORDINANCE AMENDING CHAPTER 4, TITLE XVII
OF THE 1971 CODE OF ORDINANCES OF THE CITY
OF PUEBLO RELATING TO ZONING; B -3, HIGHWAY
AND ARTERIAL BUSINESS DISTRICT
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO,
that: (Brackets indicate material to be deleted; underscoring
indicates new material added.)
SECTION 1.
Part II, Section 3, Chapter 4 of Title XVII of the 1971 Code
of Ordinances of the City of Pueblo is hereby amended to read as
follows:

(A) Does not apply on the portion of the parcel adjacent to
another parcel also in a Business or Industrial zone.
It does apply when the portion of the parcel is adjacent
to a residential or special zone (streets or alleys not
considered).

(C) See Section 17- 4- 51(17)(c).
(D) That portion of the parcel adjacent to an "expressway"
shall provide 75' of front setback.

when the side and /or rear yard property line abuts a
zone district in which residences are a use by right or
a residence which is a legal conforming use. A minimum

of the property does not abut a dedicated street or alley.]

SECTION 2.
Section 6, Chapter 4 of Title XVII of the 1971 Code of Ordinances
of the City of Pueblo is hereby amended to read as follows:

17 -4 -6: SCHEDULE OF DISTRICT REGULATIONS (PART V,
UNLIMITED HEIGHT DISTRICTS AND THE B -3 ZONE DISTRICT)
Rear Yard and Side Yard Setback. In all unlimited height
zone districts and -the B -3 Zone district the following side yard
and rear yard setback regulations shall apply at all property lines
or portions thereof which abut an existing legal conforming resi-
dential structure, or property having a zone classification in
which residences are a use by right.
(a) Structures of 35' or less in height shall have
at least a 5' side yard setback, except A -1,
A -2, B -3 and I -3 shall have at least 15'; all shall
have at least a rear yard set back of 15'.
(b) Structures greater than 35' in height shall
provide additional side yard and rear yard
setback at the minimum rate of 1' of setback
for each 1', or portion thereof, in height in ex-
cess of 35'. For example, an excess height of
12'7" requires at least 13' additional setback.
(c) Additional side yard setback shall not be re-
quired under this section of the Ordinance
when a side yard setback of 50' is achieved.
Additional rear yard setback shall not be required
under this section of the Ordinance when a rear
yard setback of 50' is achieved.
SECTION 3.
This amendment shall not affect or prevent the prosecution
or punishment of any person for any act done or committed in vio-
lation of any ordinance hereby amended prior to the taking effect
of this ordinance. If any section, subsection, clause or phrase
of this ordinance is, for any reason, held to be invalid such decision
shall not affect the validity of the remaining portions of this
ordinance.
SECTION 4.
This Ordinance shall become effective immediately upon final
passage and approval.
