HomeMy WebLinkAbout05216 r ' Y ORDINANCE NO. 5216 AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM S -1, B -4, I -2 AND I -3 WITHIN THE UNION AVENUE HISTORICAL DISTRICT TO THE HISTORIC BUSINESS (H.B.) ZONE DISTRICT BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The zoning restrictions covering the following described property shall be changed from S -1, Governmental Use District, B -4, Regional Business District, I -2, Light Industrial District, and I -3, Heavy Industrial District, to H. B., Historic Business Zone District, and that, upon passage of this ordinance, zoning restrictions affecting the H.B., Historic Business District, shall apply to said property: Lots 1 - 5, and 17 - 32, Block 48; Lots 13 - 32, Block 49; Lots 14 - 32, Block 50; Lots 11 - 16, Block 57; Lots 1 - 16, Block 58; Lots 1 - 16 and 30 - 32, Block 59; Lots 1 - 18, and 27 - 32, Block 60, all being in South Pueblo; all of Blocks 5 and 6, Central Pueblo; Lot 8, Block B, Kretschmers Subdivi- sion; All of Pueblo Union Station Subdivision; Block 45, Pueblo; and that land lying between Victoria Avenue and South Main Street from Elizabeth Street to the north -east property line of Blocks 50 and 60, South Pueblo, more commonly known as: The Union Avenue Historical District. SECTION 2. If any lawful use of property exists which would not be permitted by the regulations imposed by the Historic Business Zone District, the use may be continued so long as it remains otherwise lawful, provided: (a) Such nonconforming use shall neither be enlarged, increased, nor extended to occupy a greater area of land than was occupied at the effective date of the adop- tion of this ordinance. (b) Such nonconforming use shall not be moved in whole or in part to any portion of the lot or parcel other than that occupied by such use at the effective date of the adoption of this ordinance. j • (c) If any such nonconforming use of land ceases for any reason for a period more than six (6) consecutive months, any subsequent use of such land shall conform to the regulations for the Historic Business. Zone District. (d) The owner of the property or his representative shall file a written application for a certificate of nonconforming use and receive such certificate from the City Director of Zoning within six (6) months of the effective date of the adop- tion of this ordinance. SECTION 3. This ordinance shall become effective immediately upon final passage and approval.
