RESOLUTION NO. 12622 A RESOLUTION AUTHORIZING THE CITY OF PUEBLO TO ACCEPT THE GIFT OF A PARCEL OF PROPERTY TOTALING APPROXIMATELY .17 ACRES FROM THE LAREDO AT PARKSIDE HOMEOWNERS ASSOCIATION TO THE CITY FOR DRAINAGE WHEREAS, C.R.S. 31-25-201 authorizes the City to acquire by gift such lands or interest in land, within or without the municipal limits as in the judgment of the City Council may be necessary, suitable, or proper for park and recreation purposes for the preservation or conservation of sites, scenes, open space, and vistas of scientific, historic, aesthetic, or other public interest; and WHEREAS, the City Council desires to accept the property adjacent to the Lake Minnequa Park and Open Space for drainage and public uses including open space and park purposes; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. City Council hereby accepts the Special Warranty Deed for Parcel R, Laredo at Parkside Special Area Plan, Amendment No. 1 containing approximately .17 acres as a gift to the City of Pueblo. SECTION 2. The City Attorney is hereby authorized to record the Special Warranty Deeds in the office of the Clerk and Recorder of Pueblo County. SECTION 3. This Resolution shall become effective immediately upon passage and approval. RECOMMENDATION Approval of the Resolution. BACKGROUND In 2012, the Parks and Recreation Department entered into discussions with the homeowners association for the Parkside at Laredo Subdivision to transfer ownership of Parcel R, a drainage and public use parcel to the City of Pueblo. The transfer of the .17 acre area parcel to the City will enable direct public access from the neighborhood to the new playfield area of the park. As part of the recent park construction, the irrigation system from the park was extended to cover the .17 acre area and rock boulders were placed along the edge of the parcel to limit vehicular access into the park. This Resolution approves the acceptance of the property by the City. FINANCIAL IMPACT The City will pay $435 for a title insurance policy for the donated property. In addition, the City will be responsible for the maintenance of the land following acceptance of the donation. The property is immediately adjacent to the open grass area in the southwest corner of Lake Minnequa Park and Open Space and will be maintained as part of the new addition to the park completed in 2012.
