The following described utility and drainage easement: a��

Two parcels of land located within the northwest one - quarter of Section
14, Township 20 South, Range 65 West, of the 6 Principal Meridian, City o o "
and County of Pueblo, State of Colorado, being described as a portion of �� °
Lots 4, 5 and 6, Block 2, Westroads Subdivision, First Filing according to M "
the recorded plat thereof as filed for record at Book 2247 at Pages 636- !-.1.G;
637 in the office of the Clerk and Recorder of Pueblo County, Colorado.
Being more particularly described as:
A 10 foot Utility and Drainage Easement, 5 feet on each side of the
common line of Lots 4 and 5
and
A 10 foot Utility and Drainage Easement, 5 feet on each side of the
common line of Lots 4 and 5 on the north and Lot 6 on the south,
excepting therefrom the west 5 feet.
Is hereby vacated.
SECTION 2.
This Ordinance shall become effective immediately upon final passage and
approval.

ISSUE
Should City Council approve the proposed vacation of the drainage and public utility
easement located within Lots 4, 5, and 6, Block 2, West Roads Subdivision, First
Filing?
RECOMMENDATION
The Planning and Zoning Commission, at their December 12, 2012 Regular Meeting,
voted 5-0 to recommend approval.
BACKGROUND
The applicant is proposing to renovate, remodel, and expand the existing building
currently in use by Pueblo Dodge auto dealership showroom and service. The
additions are planned to the front, rear, and side of the building, which would cross
over the existing lot lines and public utility and drainage easement. At the time the
West Roads Subdivision, First Filing was platted in June 1985, the property was
divided into three (3) separate lots, intended for three (3) separate developments. A
public utility and drainage easement was also platted along the south of lots 4 and 5.
Now that the lots are being combined into a single lot, the easement is no longer
necessary and it impedes the ability for the applicant to add onto the building as is
necessary. Currently, no utilities are located in the easement, nor is it being used for
stormwater conveyance. The applicant has submitted letters of support from all public
utilities and the Stormwater Department.
