ORDINANCE NO 4078
AN ORDINANCE SUBMITTING TO THE QUALIFIED ELEC-
TORS OF THE CITY OF PUEBLO, A MUNICIPAL COR-
PORATION, AT THE GENERAL MUNICIPAL ELECTION TO
BE HELD NOVEMBER 4, 1975 AMENDMENTS TO THE
CHARTER OF THE CITY OF PUEBLO, COLORADO RELAT-
ING TO TERMS OF OFFICE FOR PERSONS APPOINTED
TO FILL VACANCIES IN ELECTIVE OFFICES AND THE
POPULATION OF COUNCILMANIC DISTRICTS
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO,
that (Brackets indicate material to be omitted, underscoring
indicates material to be added )
SECTION 1
The proposed amendments to the Charter of the City of Pueblo,
Colorado set forth in Sections 2 and 3 hereof shall be and hereby
are submitted to a vote of the qualified electors of the City of
Pueblo, Colorado at the general municipal election to be held
November 4, 1975 The vote of said electors shall be taken at
the same election precincts and polling places, during the same
hours, by the same judges and clerks, and in the same manner as
other votes taken at the said general municipal election Said
election shall be held and conducted, and the votes cast on the
proposed amendments shall be returned and canvassed, and the
results declared in the same manner, as nearly as may be, as pro-
vided for the election of municipal officers The City Clerk
shall cause the text of the proposed amendments together with
notice and call of said election to be timely and duly published
within 30 days after the adoption of this Ordinance
SECTION 2
The last paragraph of Section 2 -6 of the Charter of the
City of Pueblo be amended as follows
"Any vacancy in an elective office shall be filled by
appointment of the Council Any person appointed to fill a
vacancy [for an unexpired term] in an elective office shall
have the qualifications required of persons regularly elected[ ]
and shall hold the office until the next general municipal
election when the vacancy shall be filled by election accord-
ing to law and until his successor is qualified The term
of office of any officer elected to fill a vacancy shall ter-
minate at the expiration of the term during which the vacancy
occurred "
The ballot label for said charter amendment shall be
"CHARTER AMENDMENT NO 1
Shall Section 2 -6 of the Charter of the City of
Pueblo be amended to limit the term of office of a per-
son appointed to fill a vacancy in an elective office
until the next general election "
SECTION 3
That the first paragraph of Section 3 -2 of the Charter of the
City of Pueblo be amended as follows
"The Board of Elections shall establish four council -
manic districts before July 1, 1954 Such districts shall
be contiguous and compact and have [approximately the same
number of registered voters, as determined by the preceding
general municipal election The variation in number of
registered voters shall not be greater than 15% between
the district with the highest number of registered voters
and the district with the lowest number of registered voters]
population as nearly equal as may be, as required by the

Constitution of the United States Every four years
thereafter divisions, changes, and consolidations shall be
made by the Board of Elections to carry out the intent of
this Article Hereafter such redistricting shall be completed
at least six months before the general election at which it
is to become effective "
The ballot label for said charter amendment shall be
"CHARTER AMENDMENT NO. 2
Shall Section 3 -2 of the Charter of the City of Pueblo
be amended to provide that councilmanic districts have popu-
lation as nearly equal as may be, as required by the
Constitution of the United States "
SECTION 4
The votes for and against each of said proposed charter
amendments shall be registered by the use of electronic voting
equipment There shall be "yes" and "no" places on punch card
ballots which can be electronically counted by electronic tabu-
lating equipment for each of the proposed charter amendments which
will permit each elector to record his vote for or against same
SECTION 5
This Ordinance shall become effective immediately upon final
passage
SECTION 6
The City Council hereby finds, determines, and declares that
this Ordinance is necessary for the immediate preservation and pro-
tection of the public health, property, peace, and safety
