HomeMy WebLinkAbout03522 r\ , AMENDED 1 -10 -72 ORDINANCE NO. 3522 AN ORDINANCE AMENDING CHAPTER 4, TITLE XVII (ZONING) OF THE 1971 CODE OF ORDINANCES OF PUEBLO, COLORADO, BY PROVIDING FOR THE CON- DUCT OF HOME OCCUPATIONS IN R -1 TO R -6 ZONES, INCLUSIVE, AS USES BY REVIEW AND SUBJECT TO PERMIT REVIEW BY THE ZONING BOARD OF APPEALS BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that (Brackets indicate material to be deleted by this amendment; underscoring indicates new material added ) SECTION 1 Subsection (3) (c) of Section 17 -4 -51 of the Code of Ordinances is hereby amended by the addition of the - -following "(5) Home occupations." SECTION '2 Subsection (4)(c) of Section 17 -4 -51 of the Code of Ordinances is hereby amended by the addition of the following: "(5) Home occupations." SECTION 3 Subsection (5)(c) of Section 17 -4 -51 of the Code of Ordinances is hereby amended by the addition of the following "(5) Home occupations." SECTION 4 Subsection (6)(c) of Section 17 -4 -51 of the Code of Ordinances is hereby amended as follows "(4) Home occupations[, except as otherwise provided in section 17- 5 -321." SECTION 5. Subsection (7)(b) of Section 17 -4 -51 of the Code of Ordinances is hereby amended as follows "(14) [Home occupations (except as otherwise provided in section 17 -5 -32) ] Reserved " r --- ,,_,- SECTION 6 Subsection (7)(c) of Section 17 -4 -51 of the Code of Ordinances is hereby amended by the addition of the following "(8) Home occupations." SECTION 7 Subsection (8) (b) of Section 17 -4 -51 of the Code of Ordinances is hereby amended as follows "(19) [Home occupation (except as otherwise provided in section 17 -5 -32) ] Reserved SECTION 8 Subsection (8)(c) of Section 17 -4 -51 of the Code of Ordinances is hereby amended by the addition of the following "(14) Home occupations " SECTION 9 Section 17 -5 -32 of the Code of Ordinances is hereby amended as follows "17 -5 -32 Limited Use Permits. The Zoning Board of Appeals shall have power to hear and authorize or deny issuance of limited use permits for [certain personal services listed below when conducted as a] home occu- pations. [in an R-4, R -5 or R -6 residential district. A limited use permit shall be issued and may be renewed for a period of not less than one year nor more than four years, as the Board shall deem advisable ] At any time during the term of a limit- ed use permit the Zoning Board of Appeals upon notice and hear- ing to the permittee, may revoke such permit if it is deter- mined that the use is adverse or detrimental to adjoining pro- perties or to the surrounding area In making such determina- tion the Zoning Board of Appeals may consider the effect on adjoining prbperties or properties in the surrounding area of such factors as pedestrians and vehicular traffic, ingress and egress to the property, and proximity of the limited permit use to adjoining residential properties. All standards, require- ments and procedures set forth hereafter for uses by review shall also apply to issuance and renewal of limited use permits except that'limited use permits provided for in this subsection shall not run with the land, and shall not be transferable to any person other than the named permittee Vacancy or nonuse of the premises for the limited permit use for a period of one year shall be deemed prima facie proof of abandonment [Limited- permit uses A limited permit use is any of the following uses which may be allowed in the appropriate zone district upon issuance of the required permit (a) Barbershop (b) Beauty shop (c) Wig shops]" - 2 - SECTION 10 Subsections (25) (c) , (f) and (g) of Section 17 -2 -1 of the Code of Ordinances are hereby amended as follows "(25) Home occupation An occupation conducted in a dwelling unit, provided that * * * * * (c) There shall be no change in the outside appear- ance of the building or premises, or other visible evidence of the conduct of such home occupation [other than one sign, not exceed- ing one square -foot in area, nonilluminated, and mounted flat against the wall of the principal building (See Sign, Home Occupation) ] * * * * * (f) No traffic shall be generated by such home occu- pation in greater volumes than would normally be expected in a residential neighborhood[, and any need for parking generated by the conduct of such home occupation shall be met off the street and other than in a required front yard] (g) No activity shall be carried on and no equipment or process shall be used in such home occupation which creates noise, vibration, glare, fumes, odors, or electrical interference detectable to the normal senses off the lot, if the occupation is conducted in a single - family residence, or outside the dwelling unit if conducted in other than a single - family residence In the case of electrical interference, no equipment or process shall be used which creates visual or audible interference in any radio or television receivers off the premises, or causes fluctuations in line voltage off the premises * * * * *" SECTION 11 This ordinance shall become effective immediately upon final passage and approval INTRODUCED December 13 , 1971 BY DONALD E.
