PL1301, BUDGETING AND APPROPRIATING $336,100 FOR SAID PROJECT, APPROVING A GRANT AGREEMENT BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, AND THE COLORADO DEPARTMENT OF NATURAL RESOURCES, DIVISION OF PARKS AND WILDLIFE, AND AUTHORIZING THE PRESIDENT OF COUNCIL TO EXECUTE SAME WHEREAS, the City of Pueblo has received a $206,000 grant from the Colorado Department of Natural Resources, Division of Parks and Wildlife to assist in the installation of new habitat structures, as well as the restoration, adjustment, and reconstruction of some of the original habitat improvements completed in 2005 along a seven mile section of the Arkansas River below Pueblo Dam to Dutch Clark Stadium, subject to the execution of the Grant Agreement; and WHEREAS, the earlier angling habitat work within the Arkansas River in Pueblo has resulted in the establishment of a high-quality trout fishery identified as one of the top 10 trout fisheries in the U.S.; and WHEREAS, Xcel Energy, Trout Unlimited and the Packard Foundation are collectively contributing $130,100 in cash match for said Project; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. Capital Improvement Project No. PL1301, Arkansas River Habitat Project, Phase 2, is hereby established. SECTION 2. The amount of $336,100 is hereby budgeted and appropriated to the 2013 Capital Budget for said Project. SECTION 3. A Grant Agreement between the City of Pueblo, a Municipal Corporation, and the Colorado Department of Natural Resources, Division of Parks and Wildlife providing $206,000 in funding for said Project, Contract No. 13-FIF-52188, a copy of which is attached hereto having been approved as to form by the City Attorney, is hereby approved. SECTION 4. The President of City Council is hereby authorized to execute and deliver said Grant Agreement in the name of and on behalf of the City of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto. RECOMMENDATION Approval of the Ordinance. BACKGROUND The Arkansas River Habitat Project, Phase 2 will complete the addition of new habitat structures, as well as the restoration, adjustment, and the reconstruction of some of the original habitat improvements completed in 2005 along a seven mile section of the Arkansas River below Pueblo Dam to Dutch Clark Stadium. The earlier angling habitat work has resulted in the establishment of a high-quality trout fishery that is particularly popular with Front Range anglers in the November-March timeframe. In 2012, Fly Fisherman Magazine identified this section of the Arkansas River as one of the Top 10 trout fisheries in the U.S. Quality fishing regulations were enacted on a three-mile portion of the Project stretch in 2011. However, with this popularity, angler crowding has been increasing. The major purposes of the Project are to increase the amount of habitat structures in the river, increase trout populations, and to disperse angling pressure over a wider area of the river. The habitat enhancements include the modification or reconfiguration of 117 existing structures, adding 107 new in-channel habitat features, and 1,400 feet of river bank stabilization and revegetation. The Project will be completed over a two-year period between 2013 and 2014 with construction of the section between the Goodnight Barn and Pueblo Boulevard starting in 2013. The section below Pueblo Dam on U.S. Bureau of Reclamation property and the remaining work to Dutch Clark Stadium will be completed in 2014. FINANCIAL IMPACT The funding for the Project will be budgeted and appropriated in the amount of $336,100 in the "Arkansas River Habitat Project, Phase 2" Project No. PL1301. Within 30 days of the approval of the Grant Agreement, funds from Xcel Energy, Southern Greenback, Cheyenne Mountain Chapters of Trout Unlimited, and the Packard Foundation will be paid to the City. The Department of Natural Resources grant requires $103,000 in cash matching funds. There is an additional $27,100 in cash contributions that will be budgeted and appropriated for the project, but are not required to match the grant funds. The Project will be completed without the use of any City of Pueblo General Funds.
