HomeMy WebLinkAbout04828 ORDINANCE NO. 4828 AN ORDINANCE AMENDING SECTION 33, CHAPTER 5, TITLE XVII OF THE 1971 CODE OF ORDINANCES OF THE CITY OF PUEBLO RELATING TO NOTICE. PROCEDURES FOR APPLICATIONS FOR SPECIAL USE PERMITS BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: (Brackets indicate material being deleted, and underscoring indicates material being added.) SECTION 1. Subsection (b), Section 33, Chapter 5, Title XVII of the 1971 Code of Ordinances is hereby amended to read as follows: (b) Notice of such hearing shall be /given% mailed, posted and published at least ten days in advance of public hearing. LThe owner of the property for which a use by review is sought or his agent shall be notified by mail.% Notice of such hearing shall be posted on the property for which the use by review is sought and /Notice shall,Lalso be given7 be mailed to the owner of such property and to the owners of real property lying within 100 feet of the exterior boundaries of /the% such property /for which the use by review is requested by sending a copy of such notice? by /registered or certified mail, with return receipt request.7 first class mail, with postage prepaid. The word "owner" as used in this section shall be construed to mean persons who are shown to be the record owners of the properties upon the records of the Pueblo County Assessor. /In whom the record fee title is vested? /although subject to lien or encumbrance_? The holder of7 purchaser under a bona fide recorded contract of purchase shall be considered the owner for the purposes hereof. w, r A copy of such notice shall be published as by Charter provided. Proof of compliance with this section shall be by the written statement of the administrative official giving the names and addresses of the persons to whom the notice was mailed and the date of mailing, /together with the post office receipts and return receipts attached thereto,7 a statement that the required sign was posted upon such property, and the publisher's affidavit of publication. Such proof shall be filed with, and-shall become a part of, the record of the Zoning Board of Appeals. SECTION 2. This Ordinance shall become effective upon final passage and approval.
