A RESOLUTION ADOPTING A PUEBLO MEMORIAL
AIRPORT INDUSTRIAL PARK LAND TRANSFER
POLICY AND PROCEDURES RELATING THERETO
WHEREAS, the City is the owner by conveyance from the United
States Government of certain land known as the Pueblo Memorial
Airport, Pueblo, Colorado, and
WHEREAS, it would be in the best interest of the City and in
the public interest if portions of the Airport land not required
for aviation or airport use and surplus to the City's needs be
transferred and redeveloped for industrial purposes; and
WHEREAS, such transfer and redevelopment of the Airport
industrial land would create employment opportunities for the
people of Pueblo, promote the economic expansion of the City, and
advance the aeronautical activities and use of the Airport; and
WHEREAS, a land policy and procedures for the transfer and
redevelopment of the Airport industrial land surplus to the City's
needs should be adopted and implemented, Now Therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO,
that:
SECTION 1.
All applications for the transfer and redevelopment of land
within the Pueblo Memorial Airport industrial park shall be
submitted to the office of the City Manager for review to
determine if the application conforms with the following
standards:
(a) The land transfer will create new permanent full -time
employment opportunities which would not otherwise be available to
the people of Pueblo.
(b) The employment opportunities will be for primary jobs
which are independent of and not intended to serve other persons
employed at the airport or industrial park.
(c) The land transfer will not result in the relocation in
whole or in part, of an existing business or industry from the
City to the industrial park.
(d) Neither the land transfer nor the business or industry
to be located thereon will be speculative in nature.
(e) The business or industry will obtain a majority of its
customers from outside the City and will not compete in a material
manner with any existing or similar business or industry within
the City.
(f) The relocation of an industry or business to the
industrial park will not result in the imposition of sanctions
upon the City under regulations and law pertaining to federal
assistance made available for the industrial park.
(g) The nature of the business or industrial activity to be
conducted on the land to be transferred is compatible with other
industries and business located within the industrial park.
If the City's administration determines that the application
conforms with the foregoing standards, the application will be
forwarded to City Council for its further consideration. City
Council reserves the right in its absolute discretion to approve
or disapprove, or approve with modification, any application for
land transfer.
SECTION 2.
An application for land transfer which includes or proposes
any of the following shall also contain sufficient justification
and reasons therefor:
(a) a land option or right of first refusal for more than
six (6) months;
(b) the present transfer of land with any option or right of
first refusal to acquire other land in the future;
(c) more land area than is reasonably necessary or required
for the immediate intended use;
(d) vacation, removal or relocation of any road, pipeline or
utility located on the land or extension of any road or utility to
the land;
(e ) an adverse impact upon the City' s s anitary sewage
facilities or capacity;
(f) expenditure of funds by the City;
(g) payment of less than fair and adequate consideration for
the land; or
(h) any representation or warranty by City relating to the
land or improvements thereon (other than title) including
subsurface or environmental conditions.
