WHEREAS, the City of Pueblo's Historic Preservation Code, Title IV, Chapter 14,
declares that the City Council may identify, designate, and preserve those buildings,
objects, monuments, structures, and sites which reflect outstanding elements of the N a
community's architectural and cultural heritage; and N a

WHEREAS, an application was submitted by the Old Northside Neighborhood N
Organization, and the City's Historic Preservation Commission has reviewed the
application for designation as a Local Historic District and has recommended approval tit
to the Planning and Zoning Commission the designation of this district; and

WHEREAS, the motion to recommend approval of the proposed district by the ea
Planning and Zoning Commission failed by a vote of 2 to 3 without explanation; NOW, P i

BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The City Council finds and determines that the North Side Local Historic District,

Street north to 20 street as shown on attached Exhibit "A" and legally described as

SECTION 2.
The City Council hereby designates the area described in Section 1 as the North
Side Local Historic District, Phase II, subject to the benefits, obligations, and restrictions
resulting from such designation as described in Title IV, Chapter 14 of the Pueblo
Municipal Code.

SECTION 3.
Of the 84 properties surveyed in Phase II, 78 are eligible for designation as part
of the North Side Historic District, Phase II and six properties were determined to be
non- contributing. All 84 homeowners may be excluded or OPT OUT, by signing a
certified letter mailed from the Director of Planning and Community Development to the
owner on record. The OPT OUT letter must be signed and notarized by the property
owner on record and returned to the Director of Planning and Community Development a

by February 11, 2013. All Property Owners that do not timely OPT OUT of the District i ;

This Ordinance shall become effective on February 11, 2013 . A certified copy of co

properties in Exhibit "B ". In addition, the City shall send by certified mail, return receipt
requested, a copy of the Ordinance to all property owners in Phase II of the Historic
District within fourteen days of the passage of this Ordinance.

AN ORDINANCE DESIGNATING THE NORTH SIDE LOCAL HISTORIC DISTRICT,
PHASE II
ISSUE
Should City Council designate the North Side Local Historic District, Phase II, as a local
Pueblo Historic District, pursuant to the Historic Preservation Code, Title IV, Chapter 14
of the Pueblo Municipal Code?
RECOMMENDATION
Adoption of the Ordinance, as recommended by staff of the Department of Planning and
Community Development. The Historic Preservation Commission at their November 8,
2012 Regular Meeting voted 6-0 to recommend approval. A Motion to Approve the
District by the Planning and Zoning Commission at their November 14, 2012 Regular
Meeting failed by a 2-3 vote. No reasons were given by the Planning and Zoning
Commission as to why they did not support the extension of the District.
BACKGROUND
The North Side Local Historic District, Phase II, was submitted for designation as a local
Pueblo Historic District as an extension of the first North Side Historic District that was
approved in 2007 by the Old Northside Neighborhood Organization. The proposed area
contains 84 residential buildings, and 78 were determined to be eligible as contributing
buildings. The neighborhood is significant because it contains homes that represent a
broad spectrum of architectural styles from 1872 to 1955 and was the home of Pueblo’s
business and entrepreneurial elite. Pueblo’s North Side neighborhood was one of the
first planned communities with graded streets, tree lined avenues, and model homes.
The HPC has recommended that City Council allow residents 60 days to ‘opt out’ of the
historic district by providing a notarized letter making the request to the City Planning
Director. Owners who do not object in writing will be included in the proposed historic
district.
Findings of Staff and the Historic Preservation Commission, and the draft minutes of the
Planning and Zoning Commission are attached.
