AN ORDINANCE ESTABLISHING THE FOUNTAIN
CREEK WATERSHED TRAILS AND RECREATION
CAPITAL IMPROVEMENT PROJECT NO. PL1203,
BUDGETING AND APPROPRIATING $2,501,350
FOR SAID PROJECT, TRANSFERRING $997,210
FROM CP1107, WHEEL PARK FACILITY, TO
PL1203, AND $202,790 FROM THE 2013
CONSERVATION TRUST FUND, APPROVING A
GRANT AGREEMENT BETWEEN THE CITY OF
PUEBLO, A MUNICIPAL CORPORATION, AND THE
STATE BOARD OF THE GREAT OUTDOORS
COLORADO TRUST FUND, AND AUTHORIZING
THE PRESIDENT OF COUNCIL TO EXECUTE
SAME
WHEREAS, the City of Pueblo has received a $1,301,350 grant from the State
Board of the Great Outdoors Colorado Trust Fund to assist in the construction of the
Fountain Creek Watershed Trails and Recreation Project, subject to the execution of the
Grant Agreement; and
WHEREAS, Resolution No. 12331, approved by City Council on February 27,
2012, authorized the submittal of the grant application that included $1,200,000 in local
matching funds for said project; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Capital Improvement Project No. PL1203, Fountain Creek Watershed Trails and
Recreation Project, is hereby established.
SECTION 2.
Funds in the amount of $2,501,350 are hereby budgeted and appropriated to the
2012 Capital Budget.
SECTION 3.
Funds in the amount of $997,210 are transferred from CP1107, Wheel Park
Facility, to PL1203, for said Project.
SECTION 4.
Funds in the amount of $202,790 are transferred from the 2013 Conservation
Trust Fund to PL1203, for said Project.
SECTION 5.
The following projects are deactivated and any funds appropriated therefor shall
be transferred to the Conservation Trust Fund reserve: LT1102 – Parks and Recreation
Master Plan, LT1203 – Parks and Recreation Master Plan, and LT1208 – Key System.
SECTION 6.
A Grant Agreement between the City of Pueblo, a Municipal Corporation, and the
State Board of the Great Outdoors Colorado Trust Fund providing $1,301,350 in funds
for the Project, Contract No. 12609, a copy of which is attached hereto having been
approved as to form by the City Attorney, is hereby approved.
SECTION 7.
The President of City Council is hereby authorized to execute and deliver said
Grant Agreement in the name of and on behalf of the City of Pueblo, a Municipal
Corporation, and the City Clerk shall affix the seal of the City thereto.

Should the City Council establish a capital project, budget and appropriate funds in the
amount of $997,210 for the Fountain Creek Watershed Trails and Recreation Capital
Improvement Project, and approve a Grant Agreement between the City and GOCO
that will provide $1,301,350 in funds for the Project?
RECOMMENDATION
Approval of the Ordinance.
BACKGROUND
On February 27, 2012, City Council approved Resolution No. 12331, which committed
local matching funds and authorized a grant application to the Great Outdoors Colorado
Trust Fund to fund the southern portion of the Fountain Creek Watershed Trails and
Recreation Project.
The Fountain Creek Watershed Trails and Recreation Project is a multi-agency effort to
develop and/or enhance three river corridor destinations along Monument and Fountain
Creeks, develop a series of environmental education facilities interpreting the Fountain
Creek watershed, and rehabilitating portions of the Front Range Trail through Pueblo.
The Projects are the vision of agencies who are members of the Fountain Creek
Watershed, Flood Control and Greenway District. The District is comprised of three
counties and eight municipalities located within the 927-square mile watershed that
drains south into the Arkansas River at Pueblo. The Projects are spaced within three
geographical sections of the watershed that include the Historic Eastside neighborhood
in Pueblo (Southern Project Area), the rural agricultural natural area in southern El Paso
County (Central Project Area), and the creek corridor extending north through urbanized
sections of Colorado Springs (Northern Project Area). The proximity of these Projects
to densely populated urban areas and the 35 miles of rural corridor separating them,
makes the project unique and inherently valuable.
The scope of the Pueblo portion of the Fountain Creek Watershed Trails and Recreation
Project will consist of two primary components: Trail Construction and the Creek Side

Access and Activity Area. The new trail will be 12-feet wide and extend from East 8
st
Street, south to East 1 Street. Improvements along the trail will consist of pedestrian
lighting, benches, trash/recycling receptacles, information, and user/regulation signage.
The trail will be realigned to integrate with the Creek Side Access and Activity Area
located on top of the levee and adjacent to Fountain Creek. Underpass improvements
will include lighting, retaining walls, and site design to prevent loitering and transient
use.
The Creek Side Access and Activity Area will include a series of interpretive signs and
two scenic overlooks, which focus on the uniqueness of the Creek; the challenges
urban development poses to the Creek; historical exploration of trails; and the types of
habitat along the Creek corridor. The Access and Activity Area will consist of a beach
area, “East-Side Beach-Side,” as developed by the CU-Boulder School of Architecture;
ADA ramp/staircase to the creek bank, a wheel-park and plaza to facilitate community
festivals and gatherings along the Fountain Creek. The Project will be constructed in FY
2013-2014.
On June 19, 2012, Governor John Hickenlooper joined the Great Outdoors Colorado
Board in announcing $29.5 million in lottery grants to fund eight river and creek projects
across the state. The Fountain Creek Watershed Trails and Recreation Project was
one of the eight projects awarded, providing “close-to-home recreation opportunities for
Coloradans to get outdoors and enjoy, experience, and learn firsthand about nature and
the state’s waterways.”
FINANCIAL IMPACT
The funding for the Project will be established, budgeted and appropriated in the
amount of $2,501,350 in the Fountain Creek Watershed Trails and Recreation Capital
Improvement Project No. PL1203. The Grant Agreement between the State Board of
the Great Outdoors Colorado Trust Fund and the City of Pueblo requires the City to
operate, manage, and maintain the improvements made with the grant monies for a
period of 25 years from the date of completion or the useful life of the component. The
following is a breakdown of the funding for the Project:

The following projects are deactivated and any funds appropriated towards those
projects will be transferred to the Conservation Trust Fund reserve to provide the
matching funds: LT1102 – Parks and Recreation Master Plan, LT1203 – Parks and
Recreation Master Plan, and LT1208 – Key System.
