A RESOLUTION APPROVING THE TRANSFER OF A
DONATED FEDERAL RAILROAD ADMINISTRATION
PROTOTYPE VEHICLE FROM THE CITY OF PUEBLO TO
THE PUEBLO RAILWAY FOUNDATION AND
AUTHORIZING
PAYMENT IN THE AMOUNT OF $7,500 FROM THE COUNCIL
CONTINGENCIES ACCOUNT IN THE 2012 GENERAL FUND

PROTOTYPE VEHICLE
WHEREAS, in the 1980s, the Federal Railroad Administration loaned three
prototype vehicles to the City of Pueblo for use as display items at the Pueblo Weisbrod
Aircraft Museum; and
WHEREAS, in August 2000, the Federal Railroad Administration donated and
released the vehicles to the City of Pueblo; and
WHEREAS, in March 2003, one of the vehicles was loaned to Power
Superconductor Applications Corp in New Castle, Pennsylvania; and
WHEREAS, the City of Pueblo transferred two of the prototype vehicles to the
Pueblo Railway Foundation in 2008; and
WHEREAS, the City is desirous of transferring the third prototype vehicle to the
Pueblo Railway Foundation. NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Transfer of the Prototype Linear Induction Motor Research Vehicle (LIMRV) is
hereby authorized to the Pueblo Railway Foundation in its present condition “AS IS,
WHERE IS, WITH ALL ITS FAULTS” without any warranty, express or implied,
including, without limitation, the condition of the LMRV, or its merchantability or fitness
for any purpose.
SECTION 2.
The President of the City Council is authorized to execute any and all
instruments, if any, required to effect the transfer approved in Section 1 above.
SECTION 3.
Subject to Pueblo Railway Foundation acceptance of the transfer of the LIMRV
on the conditions herein set forth, an amount up to $7,500 from the Council
Contingencies Account in the 2012 General Fund Budget is authorized to be paid to
Pueblo Railway Foundation for the sole purpose of reimbursing Pueblo Railway
Foundation of up to but no more than fifty percent (50%) of costs actually incurred by
Pueblo Railway Foundation in the transportation of the LIMRV vehicle from New Castle,
Pennsylvania, to Pueblo.
SECTION 4.
This Resolution shall become effective upon passage and approval.

ISSUE
Should City Council approve the transfer of a prototype vehicle to the Pueblo Railway
Foundation and authorize the payment of $7,500 to assist with transportation costs?
RECOMMENDATION
Approval of this Resolution.
BACKGROUND
In the 1980’s, the Federal Railroad Administration loaned three prototype vehicles to the
City for display at the Pueblo Weisbrod Aircraft Museum. On August 7, 2000, the three
vehicles were donated and released to the City. Two of the vehicles were transferred to the
Pueblo Railway Foundation in 2008. The third vehicle, a Prototype Linear Induction Motor
Research Vehicle (LIMRV), was loaned to Power Superconductor Applications Corporation
(PSA) in 2003 for research purposes and was relocated to New Castle, Pennsylvania. PSA
is no longer in business, and the LIMRV must now be moved. The City wishes to transfer
the LIMRV to the Pueblo Railway Foundation. The Pueblo Railway Foundation has agreed
to take the vehicle if the City will assist in paying for a portion of the relocation costs.
FINANCIAL IMPACT
The cost to transport the LIMRV from New Castle, Pennsylvania, to Pueblo is approximately
$15,000. Council is being asked to pay for approximately half of these costs. The Pueblo
Railway Foundation has agreed to pay the remainder of the costs. Funds in the amount of
$7,500 would be paid from the Council Contingencies Account in the 2012 General Fund
Budget.
