Chapter 3 of Title XVI of the Pueblo Municipal Code, as amended, is hereby amended to add a new Section 16-3-9. thereto to read as follows: CHAPTER 3 Sewer; General Provisions Sec. 16-3-9. Excluded Substances. Discharges of wastes or waters containing selenium in excess of 17 µg/L or sulfate in excess of 310 mg/L shall be excluded from the sanitary sewer system. SECTION 2. This Ordinance shall become effective upon final passage and approval. RECOMMENDATION Approval of Ordinance. BACKGROUND The City operates its wastewater system under a discharge permit issued by the Colorado Department of Public Health and Environment. The permit requires that the City implement practices to ensure that contributions to the City’s Water Reclamation Facility do not contribute to an exceedence of water quality standards for selenium and sulfate. Selenium and sulfate are both naturally-occurring substances that enter the City’s wastewater system via groundwater intrusion rather than via waste discharges from human activities. The naturally high concentrations of these substances exceed the water quality standards of the Arkansas River. Excluding from the sanitary sewer system waste discharges containing these substances in concentrations higher than those specified is intended to achieve the requirements of the discharge permit.
