A RESOLUTION APPOINTING THE PRESIDING JUDGE OF
THE MUNICIPAL COURT
WHEREAS, §13-10-105(1)(a), C.R.S. provides in relevant part that, "Any vacancy in the
office of municipal judge shall be filled by appointment of the municipal governing body for the
remainder of the unexpired term"; and
WHEREAS, the term of Presiding Judge William Alexander, who resigned upon
appointment to the Pueblo District Court, will expire on October 26, 2012. NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
William A. Martinez is hereby appointed effective July 16, 2012 as the Presiding
Municipal Judge of the Municipal Court for the City of Pueblo for the remainder of the term
expiring on October 26, 2012. He shall act as Municipal Court Administrator and shall supervise
all Municipal Court personnel. He shall receive monthly compensation in the amount of
$9,166.66 per month.
SECTION 2.
Pursuant to §11-10-201(a) of the Pueblo Municipal Code, as amended, William A.
Martinez is also appointed as the hearing officer to constitute the Medical Marijuana Licensing
Authority of the City of Pueblo.
SECTION 3.
Resolution No. 12434 of the City Council is hereby repealed and rescinded nunc pro
tunc June 18, 2012.
SECTION 4.
This Resolution shall become effective upon passage and approval.

A RESOLUTION APPOINTING THE PRESIDING JUDGE OF THE MUNICIPAL COURT
ISSUE
Should City Council appoint William Martinez as presiding Municipal Judge, as
well as the Medical Marijuana Licensing Authority?
BACKGROUND
The City Council by Charter is authorized to appoint municipal judges for terms of two
years. With the appointment of Judge Alexander to the Pueblo County District Court on
June 1, 2012, he has resigned as municipal judge as of May 31, 2012. The term of
Judge William Alexander expires October 26, 2012. C.R.S. §13-10-105(1)(a) provides,
inter alia, that the vacancy in the office of municipal judge shall be filled by Council
appointment for the remainder of the expired term. Thus, this appointment will be for
the remaining term expiring October 26, 2012.
On June 18, 2012 Council adopted a similar Resolution which set the monthly
compensation at $8,750.00 per month. After discussing with Mr. Martinez, it is
necessary for the compensation to be increased to $9,166.66 per month. Thus this
Resolution would rescind the prior resolution.
RECOMMENDATION
Approval.
FINANCIAL IMPACT
The Presiding Judge will receive a salary and related benefits as shall be fixed by the
City Council. There are adequate funds remaining in the 2012 Municipal Court budget
to pay the salary and benefits for the remainder of this year.
