G4041Mita Phreopder RESOLUTION NO. 4339 A RESOLUTION ACCEPTING A CONVEYANCE OF REAL PROPERTY FROM THE BISHOP OF PUEBLO FOR PARK PURPOSES BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PUEBLO, that: SECTION 1. The Warranty Deed dated February 20, 1979. a copy of which is attached hereto and incorporated herein as if set out in full, from the Bishop of Pueblo conveying real property located in Pueblo County, Colorado to the City of Pueblo for park and recrea- tion purposes is hereby approved and accepted. SECTION 2. The City's administrative staff is hereby requested to include said real property in the City's parks and recreation I ' long -range planning for development. C Clerk r 1,, / • E i aooK 1979 PAGE 569 WARRANTY DEED KNOW ALL MEN BY THESE PRESENTS, That THE BISHOP OF PUEBLO, a Corporation Sole, of the County of Pueblo, State of Colorado, for the consideration of One Dollar ($1.00) and other good and valuable considerations, in hand paid, hereby sell and convey to PUEBLO, a Municipal Corporation, of the County of Pueblo, State of Colorado, the following real property situate in the County of Pueblo, State of Colorado, to -wit: A tract of land in the East one -half of Section 1, Township 21 South, Range 65 West of the 6th Princi- pal Meridian, and a portion of Block 5, City Hall Place, Second Filing, according to the recorded I',, plat thereof, being more particularly described as follows: Beginning at a point on the North right -of -way line of Mesa Avenue, said point being 15 feet tI Easterly of the centerline of Taylor Street, if produced North; thence S 89 °22' W along said North right -of -way line of Mesa Avenue, a distance of 346.37 feet; thence in a Northeasterly direction on a curve to the right whose radius is 481 feet, a distance of 387.22 feet (387.08 feet); thence N 48 °29' E (N 48 °29' W), a distance of 1.58 feet; thence N 89 °22' E and parallel to said North right - of -way line of Mesa Avenue, a distance of 180.50 feet; thence S 00 °38' E, a distance of 340 feet to the point of beginning. Containing 2.28 acres`of land, more or less; together with all appurtenances, and warrant the title to the same, subject to the 1979 and subsequent general or special property taxes, if any, which Grantee expressly assumes and agrees to pay. This conveyance is given upon the express conditions that on or before December 31, 1983, Grantee develop and commence = the use of said property as a public park and recreation area and for no other purpose whatsoever and thereafter maintain and continue using same exclusively for said public purpose. Upon Grantee's failure to comply with either of the above conditions or its future use of said property for any other purpose, title to said property shall immediately revert to Grantor or his successor or successors, and it shall be lawful for the Grantor or his successor or successors to reenter and SOAK 1979 PAGE 510 and repossess the same and thereafter to peaceably hold and enjoy the same as if these presents had not beenmade.
